AN ORDINANCE TO AUTHORIZE THE ALTERING AND CHANGING OF THE PRIMA FACIE
SPEED LIMIT FOR All VEHICLES ON THE FOLLOWING STREET IN THE CORPORATE
LIMITS OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, TO-WIT: A PORTION OF
34TH STREET AS HEREINAFTER DESCRIBED IN THE BODY OF THIS ORDINANCE;
AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS, PRESCRIBING A PENALTY;
PROVIDING FOR PUBLICATION; REPEALING All ORDINANCES IN CONFLICT HEREWITH;
PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL
NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF All OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE
WITH WHICH IT SPECIFICALLY CONFLICTS; AND PROVIDING A SAVINGS CLAUSE; AND
AMENDING ORDINANCE NO. 4288 OF THE CITY OF LUBBOCK BY DELETING SECTION 1 OF
SAID ORDINANCE TO REMOVE THE EXISTING 35 MPH SPEED LIMIT SO THAT THE 40 MPH
SPEED LIMIT HEREIN ESTABLISHED ON-SAID PORTION OF 34TH CAN BECOME EF-
FECTIVE.
WHEREAS, the governing body of the City of lubbock, as authorized by
Article 6701d, §169(b) Vernon•s Texas Civil Statutes, finds that certain
prima facie speed limits on certain streets are different from what is
reasonable or safe and should be altered and the preservation of public
health and safety required alternation of said prima facie speed limits as
hereinafter set forth, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the prima facie speed limit established by Article
6701d, §166(d)(1)--Vernon's Texas Civil Statutes as altered and changed for
all vehicles on the following designated highways or streets in the cor-
porate limits of the City·of lubbock, lubbock County, Texas, as shown
below, to-wit:
A 40 MPH speed limit on both sides of 34th Street beginning
at the west side of Avenue A and extending west to the east
side of Avenue H.
SECTION 2. THAT the City Manager is authorized and directed to
cause the placing of signs so as to clearly define the limits of the prima
facie areas set out in this Ordinance.
SECTION 3. THAT any person, firm or corporation violating the
prima facie speed limit established by this Ordinance shall upon conviction
be fined any sum not to exceed TWO HUNDRED ($200.00) DOLLARS.
SECTION 4. THAT the City Secretary is authorized and directed to
cause publication of the descriptive caption of this Ordinance together
with the penalty as an alternative method of publication as provided by
law.

SECTION 5. THAT all Ordinances or part of Ordinances conflicting
with any of the provisions hereof are hereby repealed insofar as such
conflict exists.
SECTION 6. THAT all highways or streets not specifically set forth
in the preceding sections hereof shall not be affected by the provisions
hereof, and this Ordinance shall be cumulative of all other prima facie
speed limit Ordinances except those with which it specifically conflicts.
SECTION 7. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected.
SECTION 8. THAT Ordinance No. 4288 of the City of lubbock is
hereby amended by deleting therefrom Section 1 of said Ordinance in its
entirety, and the remainder of said Ordinance shall remain the same. This
deletion is necessary to remove the existing 35 MPH Speed limit now
existing on said portion of 34th Street so that the 40 MPH Speed limit
hereinabove established can be effective.
AND IT IS SO ORDERED
