LJM:da March 21, 1985 Agenda Item #25 First Reading October 10 • 1985 Agenda Item #15 Second Reading ORDINANCE NO. 8744 AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, ENTITLED "BUILDINGS AND BUILDING REGULATION," BY AMENDING SECTION 6-22 BY CHANGING SECTION 302(c) OF CHAPTER 3 OF THE UNIFORM BUILDING CODE TO REFLECT CHANGED REQUIREMENTS FOR PLANS; AND BY ADDING A NEW SECTION 6-31.2 REVISING TABLE 5-A OF THE UNIFORM BUILDING CODE CONCERNING FIRE WAL REQUIREMENTS FOR ZERO LOT LINE DWELLINGS; AND BY RENUMBERING SECTION 6-103.1 TO 6-103.2; AND BY ADDING A NEW SECTION 6-103.1 AMENDING SECTION 302(c) OF CHAPTER 3 OF THE UNIFORM MECHANICAL CODE TO REFLECT CHANGED REQUIREMENTS FOR PLANS; PROVIDING FOR A PENALTY; PROVIDING A SAVINGS CLAUS AND PROVIDING FOR PUBLICATION. WHEREAS, the Building Board of Appeals has determined that the change hereinafter made to the Uniform Building Code are to the benefit of the public health, safety and general welfare and have recommended such change to the City Council; and WHEREAS, the Plumbing and Mechanical Board has determined that the changes hereinafter made to the Uniform Mechanical Code are to the benefit of the public health, safety and general welfare and have recommended such changes to the City Council; and WHEREAS, the City Council has determined that it is in the best interest and safety of the citizens of the City of Lubbock to adopt the changes indicted below; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT section 6-22 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: "Sec. 6-22 §302. Application for permit. Subsection,(a) of section 302 of Chapter 3 of the Uniform Building Code is amended by adding a new paragraph which shall read as follows: Whenever application is made to the building official by any person, firm or corporation for a building permit to make any con- struction, addition or structural alteration on a building or other structure, or to pave a parking lot where a permit is required by this code or any other ordinance of the city on property adjacent to or abutting on a public street, where the existing sidewalks, driveways either private or commercial, curbs, street curbs and gutters abutting such property do not conform to the basic standards, specifications, layout, details and designs provided for and established by this article, or in the event when all sidewalks, driveways, either private or commercial, curbs, street curbs and gutters required to be con- structed have not been constructed, no permit shall be issued by the building official until applicant for such permit shall agree in writing to construct, reconstruct or repair the curb, gutters, sidewalk or driveway in accordance with the code as a part of and a condition to the issuance of such building permit. No construction, addition or alteration to such buildings or other improvements placed or constructed on the adjacent private property shall be approved by the building official, until such times as all sidewalks, driveways, curbs, street curbs and gutters have been constructed or reconstructe and comply with the provisions of Chapter 24 of the Code of Ordi- nances, City of Lubbock, Texas. Subsection (c) of section 302 of Chapter 3 of the Uniform Building Code shall read as follows: (c) Information on Plans and Specifications. Plans and specifi- cations shall be drawn to scale upon substantial paper or cloth and shall be of sufficient clarity to indicate the location, nature and extent of the work proposed and show in detail that it will conform t the provisions of this code and all relevant laws, ordinances, rules and regulations. Plans for all buildings other than Group R, Division 3 and M Occupancies shall indicate how required structural and fire-resistive integrity will be maintained where a penetration will be made for electrical, mechanical, plumbing and communication conduits, pipes an similar systems." SECTION 2. THAT the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section, to be numbered 6-31.2, which said section reads as follows: "Sec. 6-31.2. Table 5-A. Wall and opening protection of occupancies based on location on property. Table 5-A, on page 61 of the Uniform Building Code is amended to add the following requirement to Group R-3: On zero lot line dwellings meeting the requirements of the City of Lubbock Zoning Ordinance allowing one unit to be built on the property line and the adjacent unit to be a minimum of ten (10) feet from the same property line, the unit that is on the property line need not be required to have a one (1)-hour fire-resistive wall at the zero property line side and only window openings shall be allowed. - 2 - This amendment shall not be interpreted as allowing either doors, roof overhangs, walls or any type of window that could project beyond the property line in either a closed or open position. It shall not apply to townhouses or to zero lot line houses that are joined together at the same property line." SECTION 3. THAT section 6-103.1 of the Code of Ordinances, City of lubbock, Texas is hereby renumbered as follows: "6-103.2. §304(a) New construction." SECTION 4. THAT the Code of Ordinances, City of lubbock, Texas is hereby amended by adding a section, to be numbered 6-103.1, which said section reads as follows: "Sec. 6-103.1. §302. Application for permit. Subsection (c) of section 302 of Chapter 3 of the Uniform Mechanical Code shall read as follows: (c) Information on Plans and Specifications. SECTION 5. THAT violation of any provision of this Ordinance shall b deemed a misdemeanor punishable by a fine not to exceed two hundred dollar as provided in Section 1-4 of the City Code. SECTION 6. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. - 3 - AND IT IS SO ORDERED.
