First Reading February 14, 1985 Agenda Item #28 Seton~ Reading February 28J 1985 Agenda Item #7 JWf:js ORDINANCE NO. 8726 AN ORDINANCE TO AUTHORIZE THE ALTERING AND CHANGING Of THE PRIMA FACIE SPEED LIMIT FOR All VEHICLES ON THE FOLLOWING STREET IN THE CORPORATE LIMITS Of THE CITY Of LUBBOCK, LUBBOCK COUNTY, TEXAS, TO-WIT: A PORTION Of FRANKFORD AVENUE AS HEREINAFTER DESCRIBED IN THE BODY Of THIS ORDINANCE; AUTHORIZING THE PLACING Of SPEED LIMIT SIGNS, PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING All ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AffECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE Of All OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECifiCALLY CONFLICTS; AND PROVIDING A SAVINGS CLAUSE. WHEREAS, the governing body of the City of lubbock, as authorized by Article 6701d, §169(b) Vernon's Texas Civil Statutes, finds that certain prima facie speed limits on certain streets are different from what is reasonable or safe and should be altered and the preservation of public health and safety required alteration of said prima facie speed limits as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: SECTION 1. THAT the prima facie speed limit established by Article· 6701d, §166(a)(1)--Vernon's Texas Civil Statutes as altered and changed for all vehicles on the following designated highways or streets in the corporate limits of the City of lubbock, lubbock County, Texas, as shown below, to-wit: A. A 55 MPH speed limit on both sides of frankford Avenue (F.M. 2528) beginning at the North City limits and extending South for 1.628 miles. B. A 50 MPH speed limit on both sides of frankford Avenue (f.M. 2528) beginning at a point 1.628 miles South of the North City limits and extending South for 0.200 mile. C. A 40 MPH speed limit on the East side of frankford Avenue (F.M. 2528) for northbound traffic beginning at a point 1.828 miles south of the north City limits and extending South 0.634 mile (to the junction of the southbound frontage lanes of loop 289). D. A 40 MPH speed limit on the West side of Frankford Avenue (F.M. 2528) beginning at a point 1.828 mile South of the North City limits and extending South for 0.200 mile. E. A 50 MPH speed limit on the West side of Frankford Avenue (F.M. 2528) beginning at a point 2.028 miles South of the North City limits and extending South for 0.434 mile (to the junction of the southbound frontage lanes of loop 289). .. . , SECTION 2. THAT the City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 3. THAT any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200.00) DOLLARS. SECTION 4. THAT the City Secretary is authorized and directed to cause publication of the descriptive caption of this Ordinance together with the penalty as an alternative method of publication as provided by law. SECTION 5. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 6. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit Ordinances except those with which it specifically conflicts. SECTION 7. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. AND IT IS SO ORDERED.
