Zoning Ord. #7084 And Lubbock Map Changes: Zone Case #2511 - 01/28/1985I' .. l II I l I i January 28, 1985 First Reading Agenda Item #19 February 14, 1985 Second Reading Agenda Item #10 LJM:da ORDINANCE NO. 8722 ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2511; CHANGE A TRACT OF LAND OUT OF SECTION 1, BLOCK D-3, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO IDP ZONING DISTRICT, LIMITED TO AN AIRPORT VALET PARKING OPERATION; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordin- ances, City of Lubbock, Texas, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2511 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 1, Block D-3, City of Lubbock, Lubbock County, Texas, from R-1 to IDP Zoning District, limited to an airport valet parking operation, located at E. Regis Street and N. Quirt Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 5.000 acre tract located in Section 1, Block D-3, Lubbock County, Texas, being further described as follows: II BEGINNING at a 5/8" iron rod set in the East right-of-way line of North Quirt Avenue for the Southwest corner of this tract which bears N. 00°13'33" W. a distance of 1980.49 feet and East a distance of 65.94 feet from the Southwest corner of Section 1, Block 0-3, lubbock County, Texas; THENCE N. 01°59'34" w., along said right-of-way, a distance of 192.04 feet to a 5/8" iron rod with cap found at a point of curvature; THENCE Northwesterly, continuing along said right-of-way and around a curve to the right, said curve having a radius of 5674.58 feet, a central angle of 01°43', tangent lengths of 85.02 feet, and a chord distance of 170.01 feet to a 5/8" iron rod with cap found at a point of tangency; THENCE N. 00°16'34" W., continuing along said right-of-way, a distance of 137.94 feet to a 5/8" iron rod with cap found at a corner of this tract; THENCE N. 46°43'42" E., a distance of 68.20 feet to a 5/8" iron rod found in the South right-of-way line of f.M. Road No. 2641 for a corner of this tract; THENCE s. 86°16'19" E., along said right-of-way, a distance of 359.41 feet to a 5/8" iron rod set for the Northeast corner of this tract; THENCE S. 01°59'34" E. a distance of 509.08 feet to a 5/8" iron rod set for the Southeast corner of this tract; THENCE S. 88°00'26" W. a distance of 415.56 feet to the Point of Beginning. SUBJECT TO THE fOLLOWING CONDITIONS: a. That the lOP zoning be limited to an airport valet parking operation. b. That prior to the issuance of any building permit on this case, a revised site plan shall be submitted detailing an adequate water system to maintain the required landscaping. In addition, a revised plan for trees shall be provided. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. - 2 -. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
