AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OffiCIAL MAP
Of THE CITY Of LUBBOCK SO AS TO MAKE THE fOLLOWING CHANGES: ZONE CASE NO.
2460-B; CHANGE A TRACT Of LAND OUT Of SECTION 10 AND 11, BLOCK E-2, CITY Of
LUBBOCK, LUBBOCK COUNTY, TEXAS, TO AMEND SITE PLAN; SUBJECT TO CONDITIONS;
PROVIDING fOR A PENALTY AS PROVIDED fOR IN SECTION 1-4 Of THE CITY CODE;
PROVIDING A SAVINGS CLAUSE; PROVIDING fOR PUBLICATION AND DECLARING AN
EMERGENCY.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient
and in the interest of the public health, morals, and general welfare to
make those proposed changes in zoning; and
WHEREAS, an emergency exists concerning the safe, orderly and health-
ful growth and development of the City in order to assure the immediate
preservation of the public peace, property, health, safety and general
welfare of the public residing within the City and such emergency requires-
suspension of the rule requiring that no Ordinance shall be finally passed
on the day of its introduction, and requires that this Ordinance become
effective immediately upon its passage; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 26 of Ordinance No. 7084, as
well as notices provided by Article 1011f, Vernon's Annotated Civil ·
Statutes, amended in 1961, and notice was duly published in the Lubbock
Morning Avalanche-Journal more than fifteen (15) days prior to the date of
the public hearing before the City Council on such proposed amendment, and
the public hearing according to said notice was duly held in the City
Council Room on the second floor of the City Hall, Lubbock, Texas, at which
time persons appeared in support of the proposal; and, after said hearing,
it was by the City Council determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of
this Ordinance and this Ordinance having been introduced prior to first
reading hereof; NOW THEREfORE:
BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK:
ZONE CASE NO. 2460-B
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:

Change a tract of land out of Section 10 and 11, Block E-2, City of
Lubbock, lubbock County, Texas, to amend site plan, subject to
conditions and being further described as follows:

METES AND BOUNDS DESCRIPTION for a 82.30 acre tract of land located in
Section 11, Block E-2, lubbock County, Texas, being shown as Tract A,
on the preliminary plat of lubbock Mall Addition, dated August 14,
1984, being further described as follows:

TRACT A
a. That C-3 specific use be limited to a Regional Mall.
b. That it be limited to 1,000,000 square feet of gross leaseable
area.
c. That the setback line shall be as illustrated on the site plan.
d. A building permit must be taken out for a minimum of 400,000
square feet on Tract A prior to May 2, 1986, or the specific use
permit on this tract shall lapse and the zoning shall revert to
its previous classification.
e. That an eight (8) foot tall brick fence shall be built concurrent
with the first building permit issued on Tracts A, F, G, H or J.
No breaks, pedestrian or otherwise, shall be allowed in the full
length of the fence.

f. That prior to issuance of a certificate of occupancy for any
structure on Tracts A and r, the owners of such structures shall
enter into an agreement with the City wherein the owners of the
structures or land in said Tracts A and r shall be jointly and
severally responsible for the maintenance of the eight (8) foot
brick fence to be constructed pursuant to the terms of this
Ordinance. In addition to the foregoing, prior to the issuance
of any certificate of occupancy for any structure to be con-
structed on Tracts A, r, G, H, or J, the owners of Tract A shall
enter into an agreement with the City wherein said owners agree
to maintain all interior public access easements, all landscaping
on Tract K, and all landscaping on the drainage easements on
Tracts G and H. The owners of any structure in Tracts r, G, H or
J may be, but shall not be required to be, parties to the
Agreement referred to in the last preceding sentence.
The agreements above required shall be made to run with the land
and be binding on all future owners of the above-described
property.
TRACT B-1
a. That C-2 specific use be limited to C-2 uses.
b. That no curb cuts shall be allowed on Quaker Avenue that are not
illustrated on the site plan.
c. That the setback line shall be as illustrated on the site plan.
TRACT B-2
a. That C-2A specific use be limited to Retail uses and Professional
Office uses.
b. That there shall be five (5) parking spaces per 1,000 square feet
of gross floor area.
c. That no curb cuts shall be allowed on Quaker Avenue that are not
illustrated on the site plan.
d. That no windows shall be permitted above the first floor for
building sides on Quaker Avenue.
e. That the setback line shall be as illustrated on the site plan.
TRACTS B-3 and B-4
a. That C-2A specific use be limited to Professional Offices.
b. That there shall be five (5) parking spaces per 1,000 square feet
of gross floor area.
c. That no curb cuts shall be allowed on Quaker Avenue except as
specified on the site plan.
d. That no windows shall be permitted above the first floor for
building sides on Quaker Avenue.
e. That the setback line shall be as illustrated on the site plan.

TRACT D
a. That C-2 specific use be limited to Bank/Offices and related
uses.
b. That there shall be five (5) parking spaces per 1,000 square feet
of gross floor area.
c. That no curb cuts shall be allowed on Quaker Avenue except as
specified on the site plan, the curb cut shown between Tracts C
and D shall not be approved.
d. That the setback shall be as shown on the site plan.
TRACT E
a. That the Zoning be approved as C-2.
b. That the setback shall be as shown on the site plan.
TRACT f
a. That C-2A specific use be limited to General Offices.
b. That the buildings setback from interior roadway shall be 30'.
c. That an eight (8) foot tall brick fence shall be built concurrent
with the first building permit issued on Tracts A, f, G, H or J.
No breaks, pedestrian or otherwise, shall be allowed in the full
length of the fence.
d. That prior to issuance of a certificate of occupancy for any
structure on Tracts A and f, the owners of such structures shall
enter into an agreement with the City wherein the owners of the
structures or land in said Tracts A and f shall be jointly and
severally responsible for the maintenance of the eight (8) foot
brick fence to be constructed pursuant to the terms of this
Ordinance. In addition to the foregoing, prior to the issuance

No breaks, pedestrian or otherwise, shall be allowed in the full
length of the fence.
d. That prior to issuance of a certificate of occupancy for any
structure on Tracts A and f, the owners of such structures shall
enter into an agreement with the City wherein the owners of the
structures or land in said Tracts A and f shall be jointly and
severally responsible for the maintenance of the eight (8) foot
brick fence to be constructed pursuant to the terms of this
Ordinance. In addition to the foregoing, prior to the issuance
of any certificate of occupancy for any structure to be con-
structed on Tracts A, f, G, H, or J, the owners of Tract A shall

TRACT K
a. That R-1 specific use be limited to open space appropriately
landscaped to be compatible with the use and tied to the site
plan.
ON All TRACTS
a. That a letter from the proponent shall be filed with the City
Council, prior to second reading, stating that they will partici-
pate on a 50-50 basis for all costs related to the installation
of any future traffic signal equipment installed as warranted by
traffic counts.

SECTION 2. THAT violation of any prov~a~ons of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars as provided in Section 1-4 of the City Code.
SECTION J. THAT due to the fact that an emergency exists concerning
the safe, orderly and healthful growth and development of the City in order
to assure the immediate preservation of the public peace, property, health,
safety and general welfare of the public within the City; therefore the
rule requiring that no Ordinance shall be finally passed on the day of ita
introduction is hereby suspended and this Ordinance shall be~ome effective
immediately upon its passage, as provided by the Charter of the City of
Lubbock.
SECTION 4. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
