Duties - 01/24/1985First Reading January 24, 1985 Agenda Item #22 Second Reading February 14, 1985 Agenda Item #16 MH:js ORDINANCE N0.8_70_6_ AN ORDINANCE AMENDING CHAPTER 2, ARTICLE X Of THE CODE Of ORDINANCES Of THE CITY Of LUBBOCK, PERTAINING TO THE PARKS AND RECREATION BOARD BY AMENDING THE DUTIES Of THAT BOARD, AND BY AMENDING THE COMPOSITION Of THAT BOARD; AND BY AMENDING THE TERMS FOR REMOVAL; AND PROVIDING fOR INTERIM PROCEDURAL CHANGES; AND PROVIDING FOR A SAVINGS CLAUSE. WHEREAS, the City Council of the City of lubbock has determined that it is in the best interest of the citizens of the City of lubbock to transfer the duties of the Cemetery Board to the Parks and Recreation Board and to adopt the changes indicated below; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: SECTION 1. THAT Chapter 2, Article X of the Code, pertaining to the Parks and Recreation Board, BE and is hereby amended by amending Section 2-259(a) to read as follows: "Sec. 2-259. Duties. (a) Except as otherwise provided in this section, the Park and Recreation Board shall be responsible for recommendations to the City Council in all matters pertaining to cemeteries, and in the areas of expansion and operational policies as well as all other acta in its opinion necessary, convenient or desirable in order to operate, maintain, enlarge, extend, preserve and promote an orderly, economic, businesslike development of the park and recreation facilities and program for the City, save and except the naming of park and recrea- tional areas shall be and remain the responsibility of the City Council after receipt of recommendation of the Board." SECTION 2. THAT Chapter 2, Article X of the Code, pertaining to the Parks and Recreation Board, BE and is hereby amended by amending Section 2-260 to read as follows: "Sec. 2-260. Composition. The Board shall consist of nine (9) members to be appointed by the City Council. The City Manager, Director of Parks and Recreation, Director of Community facilities, Director of Planning and Director of Water Utilities shall be ex officio members without a vote." SECTION 3. THAT Chapter 2, Article X of the Code, pertaining to the Parks and Recreation Board BE and is hereby amended by amending Section 2-261 to read as follows: "Sec. 2-261. Qualifications generally; removal. No person shall be appointed as a member of the Board unless he shall have been a resident elector of the City for at least two (2) years next preceding his appointment. Any member who fails to attend three (3) consecutive regular Board meetings for any reason other than sickness, absence from the City for business reasons, or emergency, or who shall fail to attend at least fifty (50) per cent of the regular meetings in any one year shall become disqualified to serve on the Board, and upon certification of such absences from the secretary of the Board, the City Council shall thereupon appoint a successor to complete the unexpired term. In the event the best interests of the appointing body require the removal of any member of the Board, his removal shall be effected through appointment of a successor by unanimous vote of the appointing body which appointed said member." SECTION 4. THAT Chapter 2, Article X of the Code, pertaining to the Parks and Recreation Board BE and is hereby amended by amending Section 2-262 to read as follows: "Sec. 2-262. Appointments from technical fields. In order that the board have technical assistance in the planning and operation of its various programs, projects and activities, five (5) members of the board shall be appointed from technical fields, one for each of the following groups, if possible: (1) Civil Engineering. (2) Design and applied arts. (3) Park and recreation management, horticulture, landscape architecture, or a related field. (4) Any technical field appropriate to the Canyon Lakes Project or other park operations. (5) A person who has a knowledge, understanding or interest in the operation of a cemetery.n SECTION 5. THAT Chapter 2, Article X of the Code, pertaining to the Parks end Recreation Board BE and is hereby amended by adding Section 2-269 to read as follows: "Sec. 2-269. Interim Procedures end Composition of the Parks and Recreation Board. The members of the Cemetery Board of the City of Lubbock shall become members of the Parks and Recreation Board of the City of - 2 - Lubbock. There shall be no appointments made upon the expiration of term or death of any member of the Board until the number of members on the Board returns to nine (9). A quorum shall consist of a majority of the members which exist at the time. This section will control when in conflict with any other section of the Code, pertain- ing to the Parks and Recreation Board, until such time as there remains only nine (9) Board members, and at such time this section shall no longer be effective, and all other sections of the Code pertaining to the Parks and Recreation Board shall be controlling. SECTION 6. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
