' I HW:da 1.0903 file And Return To Tom Nivens R-0-W January 24, 1985 Agenda Item #13 First Reading Apri-l 11, 1985· Agenda I tern # 7 Second Reading VD! 1_954 PAGE 692 ORDINANCE NO. 8704 ----- AN ORDINANCE ABANDONING AND CLOSING A 20-fOOT UTILITY EASEMENT LOCATED IN THE WHISPERWOOD ADDITION TO THE CITY Of LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY Of THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OffiCIAL MAPS Of THE CITY Of LUBBOCK TO REfLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING fOR PUBLICATION. WHEREAS, the City Council finds that the utility easement as herein- after described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: SECTION 1. THAT the utility easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use; A 20-foot utility easement located in Tract "C-1", a replat of Tracts "C" and nf", Whisperwood Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 89°56'30" W. a distance of 20.00 feet and N. 00°01 '30" W. a distance of 570.00 feet from the Southeast corner of Tract "C-1", Whisperwood Addition to the City of Lubbock, Lubbock County, Texas; THENCE N. 44°59' w. a distance of 14.15 feet; THENCE N. 89°56'30" w. a distance of 410.00 feet; THENCE N. 00°01 '30" w. a distance of 20.00 feet; THENCE S. 89°56'30" E. a distance of 410.00 feet; THENCE N. 45°01' E. a distance of 14.13 feet; THENCE S. 00°01'30" E. a distance of 40.00 feet to the POINT Of BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
