WHEREAS, the City Council finds that those portions of utility easements as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT those portions of utility easements as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use; TRACT ONE A portion of a Utility Easement, which Utility Easement in its entirety was dedicated by the Replat of Tract A, South Plains Mall Addition to the City of Lubbock, Lubbock County, Texas, recorded in Volume 1295, Pages 379-382 of the Deed Records of Lubbock County, Texas, by the dedicators, South Plains Mall, Inc., a Corporation, said portion herein concerned being described by metes and bounds as follows: BEGINNING at a point for the Northwest and beginning point of this easement; from whence the Northeast corner of Section 28, Block E-2, Lubbock County, Texas, bears North 2808.13 feet and East 1198.36 feet; THENCE N 89°59'33" E, 10.00 feet to a point for a corner; THENCE S 00°00 127'' w, 109.44 feet to a point for a corner; THENCE N 89° 59 133'' E, 30.00 feet to a point for a corner; THENCE S 00°00'2711 w, 15.00 feet to a point for a corner; THENCE S 89°59'33" w, 30.00 feet to a point for a corner; THENCE S 00°00'27" E, 84.00 feet to a point for a corner; THENCE N 89°59'33" E, 140.00 feet to a point for a corner; THENCE S 00°00'27" w, 10.00 feet to a point for a corner; VDt1961 PAGE 951 ~-. .. • ' .. TRACT TWO A portion of a Utility Easement, which Utility Easement in its entirety was dedicated by separate instrument recorded in Volume 1430, Pages 291-294 of the Deed Records of lubbock County, Texas, by the dedicators, South Plains Mall, Inc., a Corporation, said portion herein concerned being described by metes and bounds as follows: BEGINNING at a point for the Northwest and beginning point of this easement; from whence the Northwest corner of Section 28, Block E-2, lubbock County, Texas, bears North 2793.17 feet and East 1508.53 feet; THENCE N 89°59'33" E, 15.00 feet to a point for a corner; THENCE S 00°00'27" E, 318.453 feet to a point for a corner; THENCE N 89°59'33" E, 15.00 feet to a point for a corner; THENCE S 00°00'29" E, 15.00 feet to a point for a corner; THENCE S 89°59'33" w, 30.00 feet to a point for a corner; THENCE N 00°00'27" w, 333.453 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. - 2 - • AND IT IS SO ORDERED.
