Zoning Ord. #7084 And Lubbock Map For Changes: Zone Case #2500 - 12/20/1984ORDINANCE 8695 INVALID DUE TO ADVERTISING ERROR First Reading December 20, 1984 Agenda Item #10 LJM:js ORDINANCE NO. 8695 ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY or LUBBOCK so AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2500; CHANGE LOTS 4, 5, 6 AND 7, PARIS ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-3 TO C-4 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 Of THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning es hereinafter made have been duly presented to the Planning end Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient end in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS,' all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, end notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of~ this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Of LUBBOCK: ZONE CASE NO. 2500 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same ere hereby amended es follows, to-wit: Change Lots 4, 5, 6 end 7, Paris Addition, City of Lubbock, Lubbock County, Texas, from R-3 to C-4 Zoning District located at 38th Street and Paris Avenue and subject to the following conditions: SUBJECT TO THE FOLLOWING CONDITIONS: a. That it be tied to site plan as submitted. b. Recommended uses: 1. C-2 and C-3 uses. 2. Automobile and recreational vehicle sales and service and used autos, limited to wholesale dealer. 3. Auto glass shop. 4. Automobile seat cover and upholstery shop. 5. Bath and bunk house. 6. Barber and beauty supply dealer. 7. Boat and boat trailer sales and service. 8. Builders supply (all materials in a 9 building). 9. Cafe supply dealer -fixtures. 10. Candy plant. 11. Canvas goods shop, tents and awnings. 12. Dairy supply dealer. 13. Electrical supply dealer. 14. feed Store. 15. frozen food lockers. 16. Janitorial or cleaning service. 17. Job printing and lithographing. 18. Laboratory, chemical, general analysis. 19. Laundry, commercial 20. Linen and towel supply service. 21. Magazine agency. 22. Monument sales. 23. Pest control service. 24. Portable buildings sales. 25. Print shop. 26. Signs shops. 27. Store fixture sales. 28. Trailer and truck rental. 29. Trailer and truck sales, rental or service. 30. Upholstery shop -furniture 31. Wholesale sales, services, display and offices. 32. Warehousing and/or storage in conjunction with wholesale sales and/or services -one space for each two thousand (2,000 square feet) of gross floor area. b. Unless otherwise specified by the Code, permitted uses shall meet a 1/300 parking ratio. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. - 2 - SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
