AN ORDINANCE AMENDING SECTION 1 or ORDINANCE 8190 or THE CITY or
LUBBOCK so AS TO AUTHORIZE A NEW TRAFFIC SIGNAL AT THE INTERSECTION or
r.M. HIGHWAY 2528 (FRANKFORD AVENUE) AND r.M. HIGHWAY 2255 (4TH STREET)
IN THE CITY or LUBBOCK, LUBBOCK COUNTY, TEXAS; AUTHORIZING THE MAYOR TO
EXECUTE AN AGREEMENT TO BE EXECUTED BY THE CITY or LUBBOCK AND THE STATE
or TEXAS RELATING TO SAID TRAFFIC SIGNAL; AND PROVIDING FOR PUBLICATION.
WHEREAS, after traffic engineering surveys by the City of Lubbock and
State of Texas, the City Council finds it expedient to authorize a new
traffic signal to regulate the flow of traffic in the City of Lubbock as
hereinafter indicated in the body of this ordinance, and to execute an
agreement with the State of Texas with respect thereto; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY or LUBBOCK:
SECTION 1. That Section 1 of Ordinance 8190 of the City of Lubbock
is hereby amended by adding thereto authorization and approved for traffic
signals located at the following intersection within the City for Lubbock,
Lubbock County, Texas:
r.M. Highway 2528 (Frankford Avenue) and r.M. Highway 2255 (Fourth
Street).
SECTION 2. The Mayor of the City of Lubbock is hereby authorized
and directed to execute for an on behalf of the City of Lubbock an
agreement relating to said traffic signal to be entered into by and
between said City and the State of Texas, attached herewith, which shall be
spread upon the minutes of the Council and as spread upon the minutes of
this Council shall constitute and be a part of this Ordinance as if fully
copied herein in detail, and the Mayor is further authorized to endorse the
approval of the City of Lubbock upon the title sheet for the plans for said
traffic signal.
SECTION 3. That the City Secretary is hereby authorized to cause
the publication of the descriptive caption of this Ordinance as an alterna-
tive method of publication as provided by law.

This AGREEMENT, dated this
and between the State of Texas, hereinafter called the •state,• Party of
the First Part; and the City of Lubbock, Lubbock County, Texas, acting by
and through its duly authorized officers under an Ordinance/Resolution,
passed the Zo ~ day of 't)~, 19 & 4 , herinafter
called the •city,• Party of the Second Part, is made to become effective
when fully executed by both parties.
W I T N E S S E T H ----------
WHEREAS, the City has authorized the installation of highway
traffic signals by Ordinance/Resolution, passed on the 2.lJ ~day of
Cf)'~ , 19 [$ f , at the location shown on EXHIBIT 1,
attached hereto and made a part hereof;
A G R E E M E N T
NOW, THEREFORE, in consideration of the premises and of the mutual
covenants and agreements of the parties hereto to be by them respectively
kept and performed, as hereinafter set forth, it is agreed as follows:
1. The State will furnish the necessary funds for the actual
construction, prepare plans and specifications, install said highway
traffic signals, and supervise construction.
2. The City hereby consents to the construction of the highway
traffic signals shown on EXHIBIT 1 by the approval of the location and
manner of construction as shown on the plans and described in the
specifications.
3. The City will operate and maintain the highway traffic signals
at City's expense upon completion of the installation by the State.
4. The City will pay all power costs for operating the signals.

5. The City will obtain written approval of the State Department
of Highways and Public Transportation before making any changes in the
design of operation and timing of the signals or before removing any part
of the installation.
6. The City will return any and all parts of said highway traffic
signal installation to the State should it be removed by the City for any
reason other than for installation on a State or Federal numbered highway
route at a location approved by the State.
7. The City will be responsible for the police enforcement
required or securing obedience to the highway traffic signals.
8. In the event the signals installed in accordance with this
Agreement become unnecessary or are removed for any reason, this
Agreement shall terminate.
9. To the extent permitted by law, the City shall indemnify and
save harmless the State, its agents or employees, from all suits, actions
or claims and from all liability and damages for any and all injuries or
damages sustained by any person or property in consequence of any neglect
in the performance, or failure of performance of the City, its agents and
employees under this Agreement.
10. The State will not incur any financial obligation to the City
as a result of this Agreement.
