B687 AN ORDINANCE ABANDONING ANO CLOSING A PORTION Of 33RD STREET ANO THREE 15-fOOT ALLEYS IN HILLCREST COMMUNITY CENTER ADDITION TO THE CITY Of LUBBOCK, LUBBOCK COUNTY, TEXAS, ANO MORE PARTICULARLY DESCRIBED IN THE BODY Of THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS Of THE CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT ANO CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street and alley portions hereinafter described are no longer needed for street and alley purposes 1 and for public use; and ·1 WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for street and alley purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: l ; 11 SECTION 1. THAT the street and alley portions as hereinafter 1 1,. described shall BE and the same are hereby closed, vacated and abandoned for street and alley purposes and for public use; Ii l I I I BEGINNING at a point, in the North R.O.W. line of 34th Street, for the Southwest corner of lot 4, Block 4, Hillcrest Community Center Addition and for the Southeast and beginning corner of this closing; THENCE South 89°58'50" West, along the North R.O.W. line of 34th Street, 15.0 feet to a point, for the Southeast corner of Block 4, Hillcrest Community Center Addition and the Southwest corner of this closing; THENCE North 0°01'10" West, along the East line of Block 4, Hillcrest Community Center Addition and along the West line of a 15.0 foot alley, 255.0 feet to a point for the Northeast corner of Block 4, Hillcrest Community Center Addition and for a corner of this closing; THENCE South 89°58'50" West, along the North line of Block 4, Hill- crest Community Center Addition and the South R.O.W. line of 33rd Street, 79.0 feet toe point for a corner of this closing; THENCE North 0°01'10" West, 25.0 feet to an "x" in concrete, set for a corner of this closing; THENCE South 89°58'50" West, 70.31 feet to a railroad spike, set for a corner of this closing; THENCE North 53°54'20" East, along the Southeast R.O.W. line of Brownfield Highway, 42.46 feet to a point, for the West corner of Lot 1, Block 2, Hillcrest Community Center Addition and the Northwest corner of this closing; THENCE North 89°50'50" East, along the North R.O.W. line of 33rd Street and the South line of Block 2, Hillcrest Community Center Addition, 264.99 feet to a point, for the Southeast corner of Lot 4, Block 2, Hillcrest Community Center Addition and the Northeast corner of this closing; THENCE South 0°01'10" East, 65.0 feet to a point, for the Northeast corner of Lot 1, Block 3, Hillcrest Community Center Addition and for a corner of this closing; THENCE West 125.0 feet to a point; THENCE South 45° West, 14.14 feet to a point; THENCE South 0°01'10" East, along the East line of a 15.0 foot alley and along the West line of Lot 3, Block 3, Hillcrest Community Center Addition, 95.0 feet to a point, for the Southwest corner of Lot 3, Block 3, Hillcrest Community Center Addition and a corner of this closing; THENCE North B9°58'50" East, along the North line of a 15.0 foot alley, 135.0 feet to a point, for the Southeast corner of Lot 1, Block 3, Hillcrest Community Center Addition and a corner of this closing; THENCE South 0°01'10" East, 15.0 feet to a point, for the Northeast corner of Lot 6, Block 3, Hillcrest Community Center Addition and for a corner of this closing; THENCE South 89°50'50" West, along the South line of a 15.0 foot alley, 135.0 feet to a point, for the Northwest corner of Lot 4, Block J, Hillcrest Community Center Addition and for a corner of this closing; THENCE South 0°01'10" East, along the East line of a 15.0 foot alley and the West line of Lot 4, Block 3, Hillcrest Community Center Addition, 120.0 feet to the PLACE OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said abandoning and closing, showing the number of this Ordinance and the date of its final passage. - 2 - ll SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
