ORDINANCE NO. 8686
AN ORDINANCE ABANDONING AND CLOSING A PORTION OF NORTH ESSEX DRIVE AND
A 20-FOOT ALLEY IN THE HORIZON WEST ADDITION TO THE CITY OF LUBBOCK,
LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE
CITY OF LUBBOCK TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the street and alley portions
hereinafter described are no longer needed for street and alley purposes
and for public use; and
WHEREAS, the City Council finds it would be in the public interest to
close, vacate and abandon the same for street and alley purposes and for
public use; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the street and alley portions as hereinafter
described shall BE and the same are hereby closed, vacated and abandoned
for street and alley purposes and for public use;
TRACT ONE
A portion of North Essex Drive being further described as follows:
BEGINNING at a point of curvature which bears N. 45°04'08" E. a
distance of 50.00 feet from the most Westerly corner of lot 268,
Horizon West Addition to the City of Lubbock, Lubbock County, Texas;
THENCE Southeasterly, around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00
feet, and a chord distance of 21.21 feet to a point of reverse
curvature;
THENCE around a curve to the left, said curve having a radius of 50.00
feet, a central angle of 180°, and a chord distance of 100.00 feet to
a point of reverse curvature;
THENCE Northeasterly, around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00
feet, and a chord distance of 21.21 feet;
THENCE S. 45°04'08" W. a distance of 130.00 feet to the POINT OF
BEGINNING.
TRACT TWO
A 20-foot alley located in the Horizon West Addition to the City of
Lubbock, Lubbock County, Texas, being further described as follows:
BEGINNING at the Southeast corner of Lot 271, Horizon West Addition to
the City of Lubbock, Lubbock County, Texas;
THENCE N. 00°04'08" E. a distance of 63.41 feet;
THENCE N. 45°04'08" E. a distance of 94.16 feet;
THENCE S. 89°55'52" E. a distance of 170.46 feet;
THENCE N. 45°04 1 08" E. a distance of 14.14 feet;
THENCE S. 00°04 1 08" w. a distance of 40.00 feet;
THENCE N. 44°55'52" w. a distance of 14.14 feet;
THENCE N. 89°55'52" w. a distance of 162.18 feet;
THENCE S. 45°04 108" w. a distance of 77 .60 feet;
THENCE S. 00°04'08" w. a distance of 55.13 feet;
THENCE N. 89°55'52" w. a distance of 20.00 feet to the POINT OF
BEGINNING.
SECTION 2. THAT the City Engineer is hereby authorized and
directed to mark the official maps of the City of Lubbock to indicate said
abandoning and closing, showing the number of this Ordinance and the date
of its final passage.
SECTION J. THAT should any section, paragraph, sentence, phrase,
clause or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected
thereby.
SECTION 4. THAT the City Secretary is hereby authorized and
directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
