AN ORDINANCE AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES
OF THE CITY OF LUBBOCK BY ADDING THERETO A NEW ARTICLE VI EN-
TITLED "PAVING STREETS11
1 GOVERNING STREET PAVING, STANDARDS AND
DESIGN AND STRIP PAVING; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS, the City Council has determined that the changes set forth
hereinbelow are in the best interest of the citi'zens of the City of Lubbock; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 28 of the Code of Ordinances of the City of
Lubbock, BE and is hereby amended by addign thereto a new Article VI entitled
11Paving Streets 11, which shall read as follows:
ARTICLE VI. PAVING STREETS
Section 28-89. General
All pavement hereinafter constructed upon any public street
in the city by abutting property owners, their agents, ser-
vants, contractors or employees, whether under individual
or joint paving agreements or under assessment programs
shall be constructed in accordance with the standard layout,
design and specifications established herein for paving and
in accordance with standards for curb and gutter as 'described
in Section 28-48,
Section 28-90. Strip Paving
The City Council may permit the construction of strip
paving in residential streets upon making the following
determinations after holding a special paving hearing:
(a) That the cost of full width paving with curb and gutter
would create a hardship on the abutting property owners
if such cost was assessed against them,
(b} That a need exists for improvement of the streets
involved and such urgency necessitates permitting strip
paving to be constructed.
(c) That the City Council finds that strip paving is accep-
table at.,such street locations.
(d) That the strip paving shall be constructed in accordance
with the design and standards as described in Section 28-91.

Section 28-91. Standards and Design
(a) Full width paving shall consist of curb and gutter
sections6 as described in Section 28-48, with a roadway
consisting of a minimum depth of six (6) inches of com-
pacted caliche base and a four (4) course penetration type
or 1-3 / 4 inches of type 11cn hot mix asphaltic concrete
surface. The width shall be consistant with the master
thoroughfare plan.
(b) Strip paving shall consist of shaped drainage ditch
sections with a roadway consisting of 24 feet wide and a
minimum depth of six (6) inches of compacted pit run
caliche base and a 20 foot wide three (3) course pene-
tration type of 1-1 / 4 inches of type 11C" hot mix asphaltic
concrete surface.
(c) All work shall be done under the direction of the City
Engineer.
SECTION 2. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 3. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative method
provided by law.
