BY AMENDING SEC- TION 4-28 THEREOF PROVIDING FOR DATE OF LICENSE RENEWAL; AMEND-- ING SECTION 4-30 PROVIDING FOR DATE OF VACCINATION; AMENDING SEC- TION 4-32 PROVIDING FOR REPORT BY VETERINARIANS; AMENDING SEC- TION 4-36 PROVIDNG FOR CITATION FOR DOGS RUNNING AT LARGE; PRO- VIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council has determined that the changes in the regula· tion of dogs within the City would be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 4-28 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: "Section 4-28. License; application; issuance. There is herteby levied upon every dog more than six (6) months of age, which is kept., harbored or maintained by the owner thereof in the corporate limits of the city. an annual license fee of one dollar ($1. 00). which licensedee is due upon se ... curing a new or renewed license. Licenses shall be purchased at the time any dog. more than six months of age is brought into the city for keeping. harboring or maintaining, or on the date any dog reaches the age of six months. Licenses shall expire one year from the date issued and must be renewed before or upon that date. Dog licenses shall be issued by the chief animal warden or by a veterinarian appointed for such purpose under the provisions of section 4--31 of this chapter upon pay- ment of the license fee and application made upon printed forms provided for such purpose. Such ap- plication shall state the name and address of the owner or keeper of such cbg and the name, breed., color and sex of the dog being licensed. 11 SECTION 2. THAT Section 4-30 of the Code of Ordinances of the City of Lubbock. BE and is hereby amended to read as follows: "Section 4-30. Rabies vaccination prerequisite to license. The chief animal warden shall not issue or permit to be issued, any license or license tag for any dog until the owner or person in charge of such dog shall have obtained and presented to such animal warden, or to the duly authorized veterin- arian, acting as his deputy animal warden., a cer .. tificate from a v:eterinarian, licensed to practice veterinary medicine in this state., that such dog has been vaccinated for rabies as required by sec- tion 4-9 of this chapter., within a three (3) month period prior to the new or renewal date of the li- cense applied for as required by section 4-28 of this chapter." SECTION 3. THAT Section 4-32 of the Code of Ordinances of the City of Lubbock, BE and is hereby amended to read as follows: "Section 4-32. Same ..... Accounting by Veterinarians. Each veterinarian appointed under the provisions of the above section 4-31 of this Code shall account to the chief animal warden morlhly for all licenses and tags issued and make remittances to the chief animal warden for fees collected at the times so designated." SECTION 4. THAT Section 4-36 of the Code of Ordinances of the City of Lubbock, BE and is hereby amended oy adding thereto the following paragraph: "Provided however., when the animal warden., his deputies or any city policeman knows the ownership of any dog found running at large~ the dog need not be impounded but such animal warden, his deputy or any city policeman may, in his discretion~ cite the owner of such dog to appear in municipal court to answer to charges of violation of Sff:tions 4-23 and 4 ... 24 of this Code. 1' SECTION 5. THAT should any section, paragraph., sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT the City Secretary is hereby authorized to cause pub ... lication of the descriptive caption of this Ordinance as an alternative method provided by law.
