WHEREAS~ the City Council has determined that the addition to the Code of Ordinances as set forth below would be in the best interest of the citizens of the City of Lubbock, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 19 of the Code of Ordinances of the City of Lubbock BE and is hereby amended by adding thereto a new Section 19-20 which shall read as follows: 11Section 19-20. It shall be unlawful for any person to remove any box, material, equipment, firewood, or any other object from the alley in the rear of a resi- dence, whether situated on unfenced property or beyond a fence and within the alley, without the consent of the owner of the residence or the owner of the object removed. This shall not apply to normal garbage operations and the removal of garbage containers, but shall include the re- moval of other objects placed in the alley which are not marked for removal: further, this shall not prevent the enforcement of other laws and ordinances concerning health, sanitation, traffic, housing and building codes~ zoning and alley clearance. 11 SECTION 2. THAT should any section, paragraph, sentence, clause~ phrase or word of this Ordinance be declared unconstitutional or invalid for any reasop, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance,as an alternative method provided by law. AND IT IS SO ORDERED.
