WHEREAS, the City Council and the Lubbock County Commissioners' Court have determined interests would be best served by eliminating the four members appointed by the commissioners' court and having a five member City Council.appointed library Board; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL or THE CITY or LUBBOCK: SECTION 1. THAT the title of Article XIII of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Article XIII. Lubbock libraries Board. SECTION 2. THAT Section 2-329 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Sec. 2-329. Definition. For the purposes of this Article "the board" shall mean the Lubbock Libraries Board. SECTION 3. THAT Section 2-330 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Sec. 2-330. Creation; appointment, term of members. There is hereby created and established a library board to be composed of five (5) members, and such board shall be officially designated as the Lubbock libraries Board. The library director shall be an ex officio member of the library board, without voting privi- leges, and shall act in an advisory capacity to the board. The five (5) members of such board shall be appointed by the City Council and shall hold their office for a term of three (3) years. ·1 SECTION 4. THAT Section 2-329 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Sec. 2-331. Qualifications. No person shall be appointed as a member of the board unless he shall be a resident or the City of Lubbock. The agendas and minutes of each meeting will be filed with the City Secretary. The attendance of the entire board shall be recorded by the City Secretary. • u I SECTION 5. THAT Section 2-332 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Sec. 2-332. Chairman and secretary; record of proceedings. The libraries board shall appoint one of its members as chairman and one of its members as secretary. It shall be the duty of the chairman to preside at all meetings of the board, and the secretary shall keep a record of all the proceedings of the board, which record shall, upon the request of the City Council be delivered to it for its inspection and review. SECTION 6. THAT Section 2-333 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Sec. 2-333. Powers and duties. The libraries board is and shall constitute an advisory board to the City Council with authority to make recommendations from time to time, on matters pertaining to the library system. SECTION 7. THAT Section 2-334 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: Sec. 2-334. Quorum; voting. All recomendations made by the libraries board to the City Council shall be by the concurring vote of three (3) members of the board; provided, however, that this provision shall not exclude a minority recommendation which is hereby authorized to be made in writing by less than a majority of the members of the board. A majority of the total membership of the board shall constitute a quorum for the transaction of all matters to be considered by the board. SECTION e. THAT Section 2-335 of the Code of Ordinances of the City of Lubbock, Texas be and is hereby amended to read as follows: I: Sec. 2-335. Vacancies. I ' 1: I! j! I! I! 'i I I i: i ,. f ! Upon the death, resignation, removal or expiration of the terms ·; •of office of any member of the libraries board, the City Council shall nominate and appoint e successor as a member of the board who shall hold his membership for the unexpired term of the member he is appointed to succeed, or for the term of three (3) years, when the appointment is made due to the expiration of a board member's term. SECTION 9. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. r v V • I I I I . ! SECTION 10. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as en alternative method provided by law. AND IT IS 50 ORDERED.
