Applicants failed to comply with requirements within ten months 01-ZJ.+-lCUt, 02.-01-lC\w'c -ORDINANCE NO. -S393 AN ORDINANCE AUTHORIZING THE JSSUANCE OF A SPECIFIC USE PERMIT IN ZONE CASE NO. 1198-A AND PROVIDING FOR PUBLICATION. WHEREAS, after receiving the recommendations of the Planning and Zoning Commission and after due notice and public hearing and all matters having been done and performed as required by Section 14 .. A of Zoning Ordinance 1695 ofhe City of Lubbock, (said Ordinance being an Appendix to the Lubbock City Code) relating to Specific Use Permits, the City Council finds that due to changed conditions it would be expedient and in ther interest of the public heal , morals, and general welfare to authorize the granting of a Specific Use Permit as hereinafter set forth; NOW1 THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Director of Planning of the City of Lubbock is authorized to issue a Specific Use Permit to the Applicant in Zone Case No. 1198-A, in accordance with 1he recommendations and conditions imposed by the Planning and Zoning Commission, on file with the office of the Director of Planning, and the City Council, which are hereby adopted and incorporated herein by reference for all purposes, provided said Applicant agrees to be bound by the terms of the Specific Use Permit, the granting of which is hereby made subject to compliance by said Applicant with all terms of said Specific Use Permit and further subject to all provisions of Zoning Ordinance No. 1695 of the City of Lubbock, including particularly but not limited to, Section 14-A of Zoning Ordinance No. 1695 within ten months of the effective date of this Ordina e. the City Secretary-Treasurer shall be and is hereby authorized and instructed, upon written notice from the Director of Planning that Applicant has not complied with the provisions, conditions and terms imposed by this Ordinance., to note Applicant1s failure to comply on the margin of the Minutes of the City Council opposite entry of this Ordinance, and the authorization to issue such Specific Use Permit is hereby revoked; and the Director of Planning in such event is directed to remove from the Zoning Map the legend indicating such limited use. The Specific Use authorized by this Ordinance is for an apartment project, under the provisions of Section 14 .. A. 1 .. 9 from the Zoning Ordinance, on proper- ty described as all of Lot 2, and the West 158. 28t of Lot 3, excepting therefrom a tract out of the northeast corner of said West 158. 28' which is 200t north- south and 88. 45 feet east-west, of Block 31 John W.
