ORDINANCE NO. 8654 -----
AN ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY
OF LUBBOCK, TEXAS, BY AMENDING THE LANGUAGE OF SECTIONS 23-21, 23-66 AND
23-67; AND BY ADDING THERETO NEW SECTIONS 23-68 AND 23-69 PERTAINING TO
FEES CHARGED IN CONNECTION WITH THE GARBAGE AND TRASH COLLECTION SERVICE-OF
THE CITY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council deems a successful garbage and trash
collection program to be essential to the health, safety and welfare of the
citizens of the City of Lubbock; and
WHEREAS, the City Council finds that an increase in the fees charged
for such services is necessary to insure the continued viability of said
program; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 23-21 of the Code of Ordinances of the City
of Lubbock, Texas, BE and is hereby amended by amending the language of
subsection 23-21(b) to read as follows:
(b) Persons desiring to dump such wastes as described above at
the designated City landfill shall pay the following fees:

Pickups, small trailers (1/2-ton or less) ••••••••• $ 2.50
Bobtail trucks, pickups over 1/2-ton •••••••••••••• $ 7.50
Semitrailers••••••••••••••••••••••••••••••••••••••$12.50 Container trucks and packer trucks:
20 cubic yards ••••••••••••••••••••••••••••••• $25.00
24 cubic yards ••••••••••••••••••••••••••••••• $30.00
28 cubic yards•••••••••••••••••••••••••••••••$35.00
30 cubic yards ••••••••••••••••••••••••••••••• $37.50
32 cubic yards ••••••••••••••••••••••••••••••• $40.00
40 cubic yards•••••••••••••••••••••••••••••••$50.00
The City may at its option supercede the above schedule with a charge
of $5.00 per ton of waste dumped as weighed by the City.
SECTION 2. THAT Section 23-66 of the Code of Ordinances of the City
of Lubbock, Texas, BE and is hereby amended by amending the language of
subsection 23-66(a), subparagraphs (1), (2) and (3), to read as follows:
(1) Residential (one unit)--$5.80 per month.
(2) Small commercial, churches, day nurseries, private schools,
professional offices, home beauty shops, other customary home
occupations, nursing homes, orphan, maternity and geriatric
homes, lodges, sororities and fraternities generating less than
20 cubic feet per pickup--$5.80 per month.
Rooming houses without container--$5.80 per month plus $1.70 per
rental room.
Mobile home parks without containers--$5.80 per month per space.
Multi-family dwellings without containers--$5.80 per month per
unit.
(3) Multi-family (more than four units with container), mobile home
parks with container, commercial, institutional, hotels, dormi-
tories, motels, hospitals, clinics, governmental agencies, and
industrial--$11.40 per cubic yard, three yard minimum charge.
Businesses generating leas than six cubic yards per month shall
be charged at the small commercial rate.
SECTION 3. THAT Section 23-67 of the Code of Ordinances of the City
of Lubbock, Texas, BE and is hereby amended to read as follows:
Section 23-67. Scheduled extra pickups of detachable containers.
The following rates shall be applicable to all scheduled extra
pickups of detachable containers beyond the regular service of two
pickups per week:
3 cubic yards or leas ••••••••• $ 4.50 per pickup
4 cubic yards ••••••••••••• $ 6.00 per pickup
6 cubic yards ••••••••••••• $ 9.00 per pickup
8 cubic yards ••••••••••••• $12.00 per pickup
SECTION 4. THAT Chapter 23 of the Code of Ordinances of the City of
Lubbock, Texas, BE and is hereby amended by adding thereto new Sections
23-68 and 23-69, which shall read as follows:
Sec. 23-68. Civic and nonprofit events.
All schedules services for special events sponsored by c1v1c and
nonprofit organizations shall be provided at the minimum charge to
cover actual cost of service.
Sec. 23-69. Waste requiring special handling.
All waste requiring special handling by federal, state or local
regulation, if accepted, shall be charged for on the basis of actual
costs incurred by such special handling.

SECTION 5. THAT should any section, paragraph, sentence, clause,
phrase or word of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance shall not be affected
thereby.
SECTION 6 •. THAT the City Secretary is hereby authorized and directed
to cause publication of the descriptive caption of this Ordinance as an
alternative method of publication provided by law.
AND IT IS SO ORDERED.
