BfiS1' ----- AN ORDINANCE AMENDING SECTION 1-10 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK WITH REGARD TO THE ANNUAL ADJUSTMENT Of FEES CHARGED FOR LICENSES, PERMITS AND OTHER CITY SERVICES ESTABLISHED BY ORDINANCE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council desires to keep the cost of fees for City of Lubbock permits, licenses and services current with the cost of providing such services; and WHEREAS, the present formula providing for such annual adjustments is difficult to apply and inefficient; and WHEREAS, the annual adjustment should be based totally upon the actual cost of providing such services; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 1-10 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows: Sec. 1-10. Permits and fees to be adjusted annually. (a) The fees for permits, licenses and fees provided for in this Code shall be adjusted annually commencing October 1, 1984, and each year thereafter, to correspond to the actual cost of providing the applicable services. The base level for such fees shall be the amount of such fees, licenses and permits on September JO, 1984, and in no event shall any such fees, licenses and permits be reduced below the base level as published in this Code. (b) On October 1, 1984, and on each October 1st thereafter, the finance Director of the City of Lubbock shall adjust the fees provided for by this Code and such other fees as may be charged by the City of Lubbock in accordance with paragraph (a) of this Section and shall file with the City Secretary a list setting forth the adjusted fee. (c) The list filed with the City Secretary as above provided shall be the basis upon which all fees shall be charged except those set by state law or other authority, and such list shall be a public record and open to inspection by the public during all normal business hours of the City. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid • for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
