ORDINANCE NO. 8643 -----
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP or THE CITY or LUBBOCK so AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO.
2212-B; CHANGE A TRACT or LAND OUT or SECTION 5, BLOCK E, CITY or LUBBOCK,
LUBBOCK COUNTY, TEXAS, FROM C-4, C-3, R-3 AND R-1 TO C-4 AND R-2 ZONING
DISTRICTS; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR
IN SECTION 1-4 or THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient
and in the interest of the public health, morals, and general welfare to
make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 26 of Ordinance No. 7084, as
well as notices provided by Article 1011f, Vernon's Annotated Civil
Statutes, amended in 1961, and notice was duly published in the Lubbock
Morning Avalanche-Journal more than,fifteen (15) days prior to the date of
the public hearing before the City Council on such proposed amendment, and
the public hearing according to said notice was duly held in the City
Council Room on the second floor of the City Hall, Lubbock, Texas, at which
time persons appeared in support of the proposal; and, after said hearing,
it was by the City Council determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of
this Ordinance and this Ordinance having been introduced prior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2212-B
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
·Change a tract of land out of Section 5, Block E, City of Lubbock,
Lubbock County, Texas, from C-4, C-3, R-3 and R-1 to C-4 and R-2
Zoning Districts located at Loop 289 and Avenue H, subject to condi-
tions and being further described as follows:

METES AND BOUNDS description for a tract located in Section 5, Block
E, Lubbock County, Texas, being further described as follows:

BEGINNING at a point which bears S. 00°07 122" West approximately 775.9
feet from the Northwest corner of the Southwest Quarter of Section 5,
Block E, Lubbock County, Texas;
THENCE N. 00°07'22" East an approximate distance of 642 feet;
THENCE S. 87°40'13" East an approximate distance of 392 feet;
THENCE S. 00°07'22" West an approximate distance of 642 feet;
THENCE N. 87°40'13" West an approximate distance of 392 feet to the
Point of Beginning.
CONTAINS: 5.77+ Acres.

Block E, Lubbock County, Texas, being further described as follows:
BEGINNING at a point which bears S. 00°07'22" West approximately 133.9
feet from the Northwest corner of the Southwest Quarter of Section 5,
Block E, Lubbock County, Texas;
THENCE N. 00°07'22" East, along the center line of Avenue P, an
approximate distance of 570.47 feet;
THENCE s. 81°00'00" East, along the South property line of the
proposed R.O.W. of access road from Loop 289 to Interstate 27, an
approximate distance of 1,715.82 feet to a point on a curve having a
radius of 981.45 feet and a long chord of 745.24 feet to a point on a
curve having a radius of 981.45 feet and a long chord of 6.35 feet to
a point on a curve having a radius of 981.45 feet and a long chord of
664.89 feet;
THENCE S. 01°41'34" East, along the west property line of R.O.W. for
access road on Interstate 27, an approximate distance of 59.66 feet;
THENCE N. 87°40 113" West, along the center line of proposed 77th
Street, an approximate distance of 2,179.95 feet;
THENCE N. 00°07'22" East, along center line of proposed alley, an
approximate distance of 642 feet;
THENCE N. 87°40'13" West, along the center line of proposed 74th
Street, an approximate distance of 392 feet to the point of begin-
ning.

SUBJECT TO THE FOLLOWING CONDITION:
a. That the site plan be approved by the Planning end Zoning
Commission prior to the issuance of any building permits.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars as provided in Section 1-4 of the City Code.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
