Zoning Ord. #7084 And Lubbock Map Change: Zone Case #2315-A - 07/26/1984f , 4 LJM:cl Agenda Item #12 7-26-84 Agenda Item #9 8/9/84 ORDINANCE NO. 8640 ------- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2315-A; CHANGE LOT 1 AND THE EAST 38.9' OF LOT 2, BLOCK 9, ELLWOOD PLACE ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 (DH) TO R-1 (DH) LANDMARK ZONING DISTRICT; PROVIDING FOR A PENALTY AS PROVIDED fOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVING CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the Green House was built in 1928 at 2801-19th Street; and WHEREAS, architect Willford S. Bogue of fort Worth designed the home and J.B. Maxey built the house to the specifications of original owners Louis H. and Ella Bridges Howard; and WHEREAS, William Dickson ("Dick") and Miriam Collins Green bought the house in 1933; and WHEREAS, William Green was President of Wilson State Bank and owner of much ranching and commercial property in Lubbock and Lynn Counties; and WHEREAS, Miriam Green was active in civic and social affairs in Lubbock and lived in the house until 1978; and WHEREAS, the Green Home is located in the Nineteenth Street Historic District, an area of distinctive homes that symbolize the growth and prosperity of Lubbock through the years; and WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, "the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernonrs Annot,ated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and .. the public hearing according to said notice was duly held in the City Council room on the second floor of the City Hall, Lubbock, Texas, et which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: ZONE CASE NO. 2315-A SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change Lot 1 and the East 38.9' o Lot 2, Block 9, Ellwood Place Addition, City of Lubbock, Lubbock County, Texas, from R-1 (OH) to R-1 (OH) Landmark Zoning District located at 2801-19th Street, and declare same to be a historic landmark district. SECTION 2. THAT the principal building located thereon BE and is hereby declared a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic landmark structure therein, in terms of style, color, materials, texture, end basic form as found in one of the following styles: Tudor Revival, Jacobethan Revival, as described in the booklet, "Architecture in Lubbock: A Guide for Identification and Preservations," First edition, 1979. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: (1) Exterior masonry walls, including brick detailing at windows, doors, and roofline, (2) Steeply pitched polychromatic slate roof, (3) Stucco and wood half timbering in gable ends, (4) Chimneys, including decorative brickwork and chimney pots and flues, (5) Multi-light wood framed windows, -2- (6) Arched wooden front door with leaded glass panel. SECTION 5. THAT incorporated by reference into this Ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of al- teration which has already occurred and the degree of preservation of the original structure. These photographs shall be further identified as follows: ( 1 ) General View, north facade (2) General View, south facade (3) General View, west facade (4) General View, east facade (5) General View, north facade, garage addition (6) General View, south facade, garage/den addition (7) Detail, half-timbering (8) Detail, slate roof (9) Detail, north facade, windows and chimneys (10) Detail, front entrance (11) General View, garage apartment SECTION 6. THAT violation of any prov1s1ons of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed TWO HUNDRED DOLLARS as provided in Section 1-4 of the City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. -3- SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. ANO IT IS SO ORDERED. Passed by City 1984.
