Underground Utility Easement In Lots 4-B & 4-C - 05/10/1984:18i36 file Anti Return To Tom Nivens R-O-W hVOL 1902 P;V;E 824 ORDINANCE NO. 8606 AN ORDINANCE ABANDONING AND CLOSING AN UNDERGROUND UTILITY EASEMENT LOCATED IN LOTS 4-B AND 4-C, TIMES SQUARE ADDITION TO THE CITY or LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREINAFTER IN THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONING AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the underground utility easement as hereinafter described in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the underground utility easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use: A 10-foot underground utility easement located in lots 4-B and 4-C, Times Square Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows; BEGINNING at the northeast corner of lot 4-B, Times Square Addition, an addition to the City of Lubbock; THENCE S. 00°03' E. along the east line of lot 4-B and lot 4-C, a distance of 416.35 feet for the southeast corner of this easement; THENCE west a distance of 10.00 feet for the southwest corner of this easement; THENCE N. 00°03' W. a distance of 416.35 feet to a point in the north line of lot 4-B for the northwest corner of this easement; THENCE east along the north line of lot 4-B a distance of 10.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer shall mark said abandoning and closing on the official maps of the City, giving the number of the Ordi- nance, and its date of final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause the publication of the descriptive caption of this Ordinance as an alternative method of publication as provided by law. AND IT IS SO ORDERED.
