I ., ' ' .. • -i "v't/~~ I ~~~ ;fr ~Co~ ~ \.~ ~ 8-J~ ~()lt LJ-· l ~ -it.J LJM:da ORDINANCE NO. 8578 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2454; CHANGE A TRACT OF LAND OUT OF SECTION 9, BLOCK E, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM A-1 TO C-2 AND R-1 TO C-2 AND C-4 SPECIFIC USE ZONING DISTRICTS; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in .the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance end the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2454 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a Tract of land out of Section 9, Block E, City of Lubbock, Lubbock County, Texas, from A-1 to C-2 and R-1 to C-2 and C-4 Specific Use Zoning Districts located south of 82nd Street and from 300' to 670' east of University Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION for the plat limits of two tracts of land out of Section 9, Block E, Lubbock County, Texas, being further described as follows: BEGINNING et e railroad spike (found) set in the North line of Section 9, Block E, which beers East a distance of 300.00 feet from the Northwest corner of Section 9, Block E, Lubbock County, Texas; THENCE East, along the North line of Section 9, Block E~ a distance of 370.00 feet to a railroad spike (found); THENCE South at 55.00 feet pass e 1/211 iron rod (found) set in reference end at 726.00 feet pass a nail (set) in reference continuing fore total distance of 1091.80 feet to a 1/2" iron rod (set); THENCE West e distance of 179.80 feet to a 1/2" iron rod (set); THENCE North a distance of 365.80 feet to a 1/2" iron rod (set); THENCE West a distance of 190.20 feet toe 1/2" iron rod (set); THENCE North at 145. 20 feet pass a J/4" iron pipe ( found) set in reference and at 671.00 feet pass a railroad spike (found) set in reference continuing for a total distance of 726.00 feet to the Point of Beginning. CONTAINS: 7.68 acres 1 Acre of land in the NW/4 of Section 9, Block E, Lubbock County, Texas, described by metes and bounds as follows: BEGINNING at a spike set in the West line of Section 9, Block E, e distance of 580.8 ft. South of the Northwest corner of this Section, for the SW corner of the Gin 4 Acres Tract, end the Northwest end beginning corner of this one Acre Survey, Whence e 3/4" iron pipe beers E. 40 ft. by post; THENCE East JOO ft. along the South line of the Gin Tract, set 3/4" iron pipe for the Northeast corner of this one Acre; THENCE South 145.2 ft. set 3/411 iron pipe in cotton field for the Southeast corner of this Tract; THENCE West JOO ft. set spike in West line of Section 9 in paved road for the Southwest corner of this one Acre Tract. Whence a 3/4" iron pipe bears East 40 ft.; THENCE North 145.2 ft. with the West line of Section 9, and along paved road (College Avenue) to the Place of Beginning; and containing One Acre of Lend. - 2 - SUBJECT TO THE FOLLOWING CONDITIONS: a. That the C-2 zoning be tied to the site plan es pr~sented. b. That the site plan be corrected prior to 1st reeding City Council. SECTION 2. THAT violation of any provisions of this Ordinance shell be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars es provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shell not be effected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance es ~n alternative· method provided by law. AND IT IS SO ORDERED.
