AN ORDINANCE ordering a special election to
be held in the City of Lubbock, Texas,
on the question of the adoption of a one
percent (1%) local sales and use tax
within the City; designating the day of
the election and the polling places;
appointing election officials therefor;
providing that all duly qualified resident
electors shall be qualified to vote; pres-
cribing form of ballot; providing for
notice of election; containing other pro-
visions relating to said election; pro-
viding for severability; and declaring an
emergency.
WHEREAS, Article 1066c, Vernon's Texas Civil Statutes
{Acts 1967, 60th Legislature, Regular Session, Chapter 36, Page
62) authorizes the governing body of any city, town or village in
Texas to call an election for the purpose of adopting a local
sales and use tax within such city, town or village; and
WHEREAS, the City Council of the City of Lubbock, Texas,
hereby finds, determines and adjudges that it is necessary and to
the best interests of the City to call an election for the purpose
of adopting a local sales and use tax within said City at the ear-
liest possible date for the immediate preservation of the public
peace, property, health and safety of the citizens of the City of
Lubbock, and that by virtue thereof this ordinance shall be passed
and adopted as an emergency measure; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
SECTION 1: That a special election shall be held in
and throughout the City of Lubbock, Texas, on the 9th day of
November, 1967, at which election there shall be submitted to the
resident qualified voters of said City, for their action there-
upon, the following propositions:
"FOR adoption of a one percent (1%) local
sales and use tax within the City."
nAGAINST adoption of a one percent (1%)
local sales and use tax within the City."
SECTION 2: That said election shall be held in each of
the election precincts .within said City, and the polling places
and pres~a~ng officers for each of said precincts sha ll be,
respectively, as follows, to wit:

If the regularly appointed Presiding Judge is unable to
serve at the election, the Alternate Presiding Judge therefor
shall serve as Presiding Judge. The Presiding Judge shall appoint
at least two (2) Clerks (one of whom shall be the Alternate Pre-
siding Judge if the election is conducted by the regularly appointed
Presiding Judge) and not more than six (6) additional Clerks, as
he deems necessary for the proper conduct of the election.
ABSENTEE VOTING shall be conducted at the City Secre-
tary's Office in the City Hall, in accordance with the provisions
of Chapter 5, V.A.T.C.S., Election Code.
SECTION 3: That said election shall be held in accord-
ance with the Constitution and laws of the State of Texas, and all
duly qualified resident electors of the City of Lubbock, Texas,
shall be qualified to vote.
SECTION 4: That the ballots for said election shall be
prepared in sufficient number and in conformity with Chapter 6,
V.A.T.C.S., Election Code, and printed on such ballots shall appear
the following proposition:

ADOPTION OF A ONE PERCENT (1%) LOCAL
SALES AND USE TAX WITHIN THE CITY
The word "FOR" and beneath it the word "AGAINST" shall
be made to appear to the left of the proposition. A square shall
be printed on the left of each of the words "FOR11 and "AGAINST" and
each voter shall place an "X" in the square beside the statement
indicating the way he wishes to vote.
SECTION 5: That notice of the election hereby ordered
and called shall be given: (a) by publication on the same day of
two successive weeks in a newspaper of general circulation pub-
lished within said City, the date of the first publication to be at
least twenty-one (21) days prior to the date set herein for such
election; and (b) by posting of such notice at the polling place
in each of the election precincts of the City not less than twenty
(20) days prior to the date set herein for such election. It is
hereby found and determined that the LUBBOCK AVALANCHE-JOURNAL is
1a newspaper published within the City of Lubbock, Texas, and is a
newspaper of general circulation within said City.
SECTION 6: If any of the provisions of this ordinance
or the application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the
invalid provision or application, and to this end the provisions
of this ordinance are declared to be severable.
SECTION 7: The public importance of this measure and the
fact that it is to the best interest of the City of Lubbock to call
an election for the purpose of adopting a local sales and use tax

preservation of the public peace, property, health and safety of the
citizens of said City constitute and create an emergency and an ~rgent public necessity requiring that this ordinance be passed and
ake effect as an emergency measure, and that this ordinance is
ccordingly passed as an emereency measure and shall take effect
~nd be in force immediately from and after its passage, and it is
so ordained.
