HomeMy WebLinkAboutOrdinance - 5335-1967 - Election To Be Held On 11-9-1967 - 10/10/196710-\0-lC\Ui- ORDINANCE NO . 53 3 _s- AN ORDINANCE of the City Council of the City of Lubbock, Texas , ordering that an election be held in said City on the 9th day of Novem- ber, 1967, for the purpose of submitting to the resident qualified electors of the City who own taxable property in the City and who have duly rendered the same for taxation, propositions for the issuance of bonds of said City; designa ting the places at which said election shall be held; appointing the officers of said election; providing for notice of said election; enacting provisions incident and relating to the subject and purpose of said ordinance; and declaring an emergency. WHEREAS, the City Council of the City of Lubbock, Texas, deems it advisable and in the City's best interest that bonds of the City be authorized and issued for the purposes hereinafter I stated; and I WHEREAS, the City Council has found and hereby declares I there is an urgent public necessity for the acquisition and con- struction of the improvements to be provided with the proceeds o£1 said bonds at the earliest pos sible date for the immediate preser- vation of the public peace, property, health and safety of the citizens of the City of Lubbock, and that by virtue thereof this ordinance shall be passed and adopted as an emergency measure; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1: That an election be held on the 9th day of November, 1967, which date is not less than fifteen (15) nor more than thirty (30) days from the date of the adoption of this ordi- nance, at which election the following propositions shall be sub- mitted to the resident qualified electors of said City, who own taxable property therein, and who have duly rendered the same for taxation: PROPOSITION NUMBER 1 11SHALL the City Council of the City of Lubbock, Texas, be authorized to issue ONE MILLION TWO HUNDRED EIGHTY-FIVE THOUSAND DOLLARS ($1,285,000) general obli- gation bonds of said City for the purpose of making permanent public improvem ents, to wit: constructing improvements and extension s to the City's Waterworks System; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rat e not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and inter- est on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?11 PROPOSITION NUMBER 2 "SHALL the City Council of the City. of Lubbock, Texas, be authorized to issue TWO MILLION THREE HUNDRED NINETY-FIVE THOUSAND DOLLARS ($2,395,000) general obli- gation bonds of said City for the purpose of making permanent public improvements, to wit: constructing improvements and extensions to the City's Sanitary Sewer System; said bonds to mature serially over a period of years not to exceed forty (40) years from their date, and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and inter- est on said bonds by l evying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 3 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue SIX MILLION EIGHT HUNDRED SEVEN THOUSAND DOLLARS ($6,807,000) general obligation bonds of said City for the purpose of making permanent public improvements, to wit: constructing street improve- ments in and for said City, including the acquisition of necessary right-of-way for expressways and other streets; said bonds to mature serially over a period of years not to exceed forty (40) years from their date, and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per ~num, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION ~~ER 4 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue THREE MILLION DOLLARS ($3,000,000) general obligation bonds of said City for the purpose of making permanent public improvements, to wit: constructing and equipping a Civic Center and the acquisition of a site therefor; said bonds to mature seri- ally over a period of years not to exceed forty (40) years from their date, and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of prin- cipal of and interest on s aid bonds by l evying a tax suf~ ficient to pay the annual interest and to create a sinking fund sufficient to redeem sa id bonds as they become due?" PROPOSITION NUMBER 5 "SHALL the City Council of the City of Lubbock, Texas, b e authorized to i s sue ONE MILLION SIX HUNDRED TEN THOUSAND DOLLARS ($1,610,000) general obligation bonds of said City for the purpose of making permanent public improvements, to wit: acquiring or improving, either or both, land for park purposes; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 6 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue the bonds of said City in the amount of NINE MILLION FIVE HUNDRED THOUSAND DOLLARS ($9,500,000), maturing serially in such install- ments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, bearing interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, for the purpose of making permanent public improvements, to wit: extending and improving the City's Electric Light System, to be issued in accordance with and secured in the manner provided in Article 1111, et seqq., V.A.T.C.S., each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be · raised by taxation, and secured by a pledge of the net revenues from the operation of the City's Electric Light System?n PROPOSITION NUMBER 7 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue EIGHT HUNDRED THOUSAND DOLLARS ($800,000) general obligation bonds of said City for the purpose of making permanent public improvements, to wit: the acquisition, construction and equipping of a library building in and for said City and the acquisi- tion of a site therefor; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of prin- cipal of and interest on said bonds by/levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 8 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue ONE MILLION THREE HUNDRED SEVENTY THOUSAND DOLLARS ($1,370,000) general obligation bonds of said City for a pub lie purpose, to '11i t: the construction and equipment of a sanitation-garbage-trash disposal facility, a public utility for said City, includ- ing the acquisition of land therefor; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 9 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue TWO HUNDRED FIFTEEN THOU- SAND DOLLARS ($215,000) general obligation bonds of said City for the purpose of making permanent public improve- ments, to wit: constructing, improving and equipping fire station buildings and the purchase of necessary sites therefor in and for said City; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of prin- cipal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?11 PROPOSITION NUMBER 10 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue THREE HUNDRED FIFTY THOU- SAND DOLLARS ($350,000) general obligati"on bonds of said City for the purpose of making permanent public improve- ments, to wit: constructing and equipping a maintenance garage for City vehicles and the acquisition of a site therefor; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?11 PROPOSITION NUMBER 11 "SHALL the City Council of the City of Lubbock, Texas, be authorized to issue ONE MILLION NINE HUNDRED FIFTY THOUSAND DOLLARS ($1,950,000) general obligation bonds of said.City for the purpose of making permanent public improvements, to wit: constructing, enlarging, extending and installing storm sewers, drains, and gutters, and other improvements incidental thereto, including acquisition of land for drainage purposes and drainage area modifications for mosquito control; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" The Presiding Judge shall appoint at least two (2) Clerks (one of whom shall be the Alternate Pre- siding Judge if the election is conducted by the regularly appointed Presiding Judge) and not more than six (6) additional Clerks, as he deems necessary for the proper conduct of the election. ABSENTEE VOTING shall be conducted at the City Secre- tary's Office in the City Hall, in accordance with the provisions of Chapter 5, V.A.T.C.S., Election Code. SECTION 3: That said election shall be held under the provisions of and in accordance with the laws governing the issu- ance of municipal bonds in cities, as provided in the General Laws of the State of Texas, and only resident qualified electors, who own taxable property in the City, and who have duly rendered the same for taxation, shall be qualified to vote. SECTION 5: That a copy of this ordinance, signed by the Mayor of the City and attested by the City Secretary, at the top of which shall appear the words "NOTICE OF ELECTION FOR THE ISSUANCE OF BONDS", shall serve as proper notice of said election. Said notice shall be posted at the City Hall and at each of the polling places in said City, not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in the LUBBOCK AVALANCHE-JOURNAL, which is a newspaper of general circulation in and published in the City of Lubbock, Texas, the first of said pub- lications to be made not less than fourteen (14) full days prior to t he date set for said election. ; SECTION 6: The public importance of this measure and the fact that it is to the best interest of the City of Lubbock to provide the improvements indicated by the propositions for the issuance of bonds hereinabove set out at the earliest possible date for the immediate preservation of the public peace, property, health and safety of the citizens of said City constitute and create an emergency and an urgent public necessity requiring that this ordinance be passed and take effect as an emergency measure, and that this ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage, and it is so ordained.
