WHEREAS, the City Council of the City of Lubbock on April 10, 1980, established its then existing two Municipal Courts as Municipal Courts of Record in accordance with Vernon's Annotated Civil Statutes, Article 1200gg, by means of Ordinance No. 8032; and WHEREAS, the City Council now finds that the workload of the Municipal Courts of Record is much reduced from previous levels at the present time; and WHEREAS, the City Council finds that at the present time there exists insufficient work for two Courts and two Judges; and WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of Lubbock to reduce the number of Municipal Courts of Record from two courts to one court effective with the regular General City Election of April 7, 1984; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Sections 17-1, 17-2 and 17-3 of the Code of Ordinances of the City of Lubbock BE and are hereby amended to read as follows: Sec. 17-1. Established. The City of Lubbock's two existing Municipal Courts of Record, which were established April 7, 1980, in accordance with the pro- visions of Vernon's Annotated Civil Statutes, Article 1200gg, are hereby reduced to a single Municipal Court of Record, effective with the regular General City Election of 1984. The Court shall have a single judge, who may be assisted from time to time by slbstitute, temporary or part-time judges appointed by the City Council. The City Council may hereafter by Resolution provide for the division of the Court into one or more divisions as required by the Court's workload prior to any General City Election. Each such division shall be presided over by its own full-time or part-time judge at the dis- cretion of the City Council. I .. • • JI>. Sec. 17-2. Operation, Procedure. The operation and procedure of the Municipal Court of Record shall be as provided for by Vernon's Annotated Civil Statutes, Article 1200gg. Sec. 17-3. Summoning, impaneling and payment of jurors. Upon delivery of jury lists drawn for the Municipal Court of Record to the clerk of the Court, jurors shall be summoned, impaneled and paid in accordance with procedures established by the presiding judge of the Municipal Court of Record. SECTION 2. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shell not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized end directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
