Zoning Ord. #7084 And Lubbock Map Changes: Zone Case #1598-8 - 01/26/1984JMS:da ORDINANCE NO. ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 70B4 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1598-B; CHANGE A TRACT OF LAND OUT OF SECTION 37, BLOCK A-K, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM C-3 TO C-4 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1598-B SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 37, Block A-K, City of Lubbock, Lubbock County, Texas from C-3 to C-4 Zoning District, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 12.5 acre tract located in Section 37, Block A-K, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears West a distance of 1930.0 feet and South a distance of 40.0 feet from the Northeast corner of Section 37, Block A-K, Lubbock County, Texas; THENCE East a distance of 265.81 feet to a Northerly corner of this tract; THENCE S. 00°01' E. a distance of 17.82 feet to a corner of this tract; THENCE N. 89°59' E. a distance of 94.90 feet to a point of curvature; THENCE Southeasterly around a curve to the right, said curve having a radius of 215.00 feet, a central angle of 69°41', tangent lengths of 149.66 feet, a chord distance of 245.66 feet, and an arc length of 261.48 feet to a point in the Westerly right-of-way line of Loop 289; THENCE S. 20°20' E., along the Westerly right-of-way line of Loop 289, a distance of 736.70 feet to a point in said right-of-way line of Loop 289; THENCE S. 20°06' E., along said right-of-way line, a distance of 30.33 feet to the Northeast corner of Lot 2, Camelot Addition for the Southeast corner of this tract; THENCE West, along the North line of said Lot 2, Camelot Addition, a distance of 528.26 feet to a Southerly corner of this tract. THENCE North a distance of 100.50 feet to an interior corner of this tract; THENCE West a distance of 300.50 feet to a Westerly corner of this tract; THENCE North, along the East line of Lot 1, Camelot Addition, a distance of 777.00 feet to the Point of Beginning. SUBJECT TO THE FOLLOWING CONDITIONS: a. That the change to C-4 only be granted for the lot described as Lot 3. b. That it be tied to the site plan. c. That it be limited to a building supply center. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. • AND IT IS SO ORDERED.
