HomeMy WebLinkAboutResolution - 2019-R0440 - Amendment 1 To Contract With Lee Lewis Construction - 11/19/2019 Resolution No. 2019-RO440 Item No. 7.3 November 19,2019 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, Amendment No. 1 to Construction Manager at Risk contract 14224 for construction services related to three (3) police substations, by and between the City of Lubbock and Lee Lewis Construction, Inc., of Lubbock, Texas, and related documents. Said Contract is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. THIS IS THE FIRST AMENDMENT TO THE AGREEMENT dated and entered into the 12th day of February 2019 by and between the City of Lubbock ("City") and Lee Lewis Construction, Inc. ("LLCI"), of Lubbock Texas, for providing Construction Manager at Risk services for three (3) Police Department Substations, located on three(3) different city-owned properties. WITNESSETH: WHEREAS, in accordance with Article 2, Sections 2.3.1 and 2.3.8 of said agreement LLCI proposes the Guaranteed Maximum Price(GMP)of seventeen million nine hundred eight thousand two hundred seventy- seven and 00/100 ($17,908,277) as evidenced in Exhibits A and B, attached and incorporated herein. WHEREAS, in accordance with Article 2, Section 2.3.4.5 of the agreement, as a component part of the GMP,the time required for substantial completion proposed by LLCI is eighteen(18)months. WHEREAS, all other portions of the original Agreement and previous Amendments, if any, shall remain in place and are not altered by this amendment. NOW,THEREFORE,the City and LLCI agree to the following terms in this FIRST AMENDMENT: 1. The GMP for CMAR services for three (3) Police Department Substations shall be seventeen million nine hundred eight thousand two hundred seventy-seven and 00/100($17,908,277);and 2. The time required for substantial completion for said services shall be eighteen(18)months. IN WITNESS HEREOF,the parties have executed this Agreement as of this 19th day of November,2019.
