AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 Of THE CITY Of
LUBBOCK, BEING THE ZONING CODE, SO AS TO MAKE THE FOLLOWING CHANGE: ZONE
CASE NO. 2438; CHANGE A TRACT Of LAND BEGINNING AT THE POINT Of INTER-
SECTION Of THE WEST LINE Of CHICAGO AVENUE AND THE SOUTH LINE OF 22ND
STREET IN THE CITY or LUBBOCK; THENCE, WEST 15 FEET TO A POINT or CURVA-
TURE; THENCE, NORTHWESTWARD AROUND A CURVE TO THE RIGHT WITH A RADIUS or
400 FEET, IN THE SOUTH LINE or 22ND STREET, A DISTANCE or 247.B FEET TO A
POINT TANGENCY; THENCE, NORTH 52°30' WEST ALONG THE SOUTH LINE OF 22ND
STREET, 275.25 FEET TO THE POINT Of BEGINNING or THIS TRACT; THENCE, NORTH
52°30' WEST ALONG THE SOUTHWEST LINE or 22ND STREET A DISTANCE or 100 FEET;
THENCE SOUTH 37°30' WEST A DISTANCE OF 165 FEET; THENCE, SOUTH 52°30' EAST
A DISTANCE OF 100 FEET; THENCE, NORTH 37°30' EAST A DISTANCE or 165 FEET TO
THE PLACE or BEGINNING; LUBBOCK, LUBBOCK COUNTY, TEXAS FROM A-2 TO A-2 (DH)
ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; IDENTIFYING CERTAIN
EXTERIOR ARCHITECTURAL FEATURES OF THAT LANDMARK; PROVIDING FOR A PENALTY
AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATION.
WHEREAS, the Arnett House was designed by noted Fort Worth Architect
M.L. Waller and built at the Northwest corner of 13th and Avenue Lin 1915,
and
WHEREAS, the house was built for Mr. and Mrs. J. Lanham Higginbotham
of the family that owned Higginbotham Bartlett Lumber Company, and
WHEREAS, Mr. and Mrs. S.C. Arnett, Sr. lived in the house from 1918
until 1956, and
WHEREAS, Mr. Arnett was a rancher, president and Chairman of the Board
of Citizen's National Bank, and an outstanding early civic leader, and
WHEREAS, in 1956 Dr. and Mrs. Sam C. Arnett, Jr. donated the house to
Lubbock Christian College where it served as the school's first administra-
tion building, and
WHEREAS, the Arnett House was completely renovated by L.C.C. Asso-
ciates, a women's support group which has made a substantial contribution
to Lubbock Christian College since its organization in 1958, and
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, the City Council finds that it
would be in the best interest of the public welfare to make those proposed
changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 26 of Ordinance No. 7084, as
well as notices provided by Article 1011f, Vernon's Annotated Civil
Statutes, amended in 1961, and notice was duly published in the Lubbock
Morning Avalanche-Journal more than fifteen (15) days prior to the date of
the public hearing before the City Council on such proposed amendment, and
the public hearing according to said notice was duly held in the City
Council Room on the second floor of the City Hall, Lubbock, Texas, at which
time persons appeared in support of the proposal; and, after said hearing,
it was by the City Council determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of
this Ordinance and this Ordinance having been introduced prior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Of LUBBOCK:
ZONE CASE NO. 2438
SECTION 1. THAT a tract of land Beginning at the point of intersec-
tion of the West line of Chicago Avenue end the South line of 22nd Street
in the City of Lubbock; Thence, West 15 feet to a point of curvature;
Thence, Northwestward around a curve to the right with a radius of 400
feet, in the South line of 22nd Street, a distance of 247.8 feet to a point
tangency; Thence, North 52°30' West along the South line of 22nd Street,
275.25 feet to the point of beginning of this tract; Thence, North 52°30'
West along the Southwest line of 22nd Street a distance of 100 feet;
Thence, South 37°30' West a distance of 165 feet; Thence, South 52°30' East
a distance of 100 feet; Thence North 37°30' East a distance of 165 feet to
the place of beginning; Lubbock, Lubbock County, Texas BE and is hereby
changed from A-2 to A-2 (DH) zoning district, and declared to be a historic
landmark district.
SECTION 2. THAT the principal structure located thereon BE and is
hereby declared a historic landmark.
SECTION 3. THAT any new buildings or structures within this historic
landmark district shall be architecturally compatible with the historic
landmark structure therein, in terms of style, color, materials, texture,
and basic form as found in the following style: Bungalow, as described in
the booklet, "Architecture in Lubbock: A Guide for Identification and
Preservation," first Edition, 1979.
SECTION 4. THAT the following BE end are hereby declared to be
exterior architectural features, end es such shall be preserved in their
present form:
1) Exterior walls of wood siding,
2) Wood shingle roofs, dormers, and gable ends,
3) Ornamental woodwork, including exposed eaves, bracketed purlins,
and porch support posts,
4) Wooden multi-light entrance doors,
5) Shape, configuration, and division of wood windows and window
openings,
6) Arrangement of porch and porch walls and supports,
7) Wood surfaces shall be painted as needed for protection and
appearance, with a color of paint similar to that used at
present.
SECTION 5. THAT incorporated by reference into this ordinance, and by
attaching hereto, are photographs of the building as it presently appears.
Said photographs shall be used to indicate the degree of alteration which
has already occurred and the degree of preservation of the original struc-
ture. These photographs shall be further identified as follows:
1) General view, front
2) General view, north facade
J) General view, east facade
4) General view, south facade
5) General view, west facade
6) General view, rear
7) Close view, east dormer
8) Close view, french doors, east porch
9) Close view, front entrance
10) Close view, typical windows, west side
11) Close view, porch supports
12) General view, garage.
SECTION 6. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars as provided in Section 1-4 of the City Code.
SECTION 7. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION a. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
