Zoning Ord. #7084 And Lubbock Mapchanges: Zone Case #2433. - 01/26/1984JMS:da ORDINANCE NO. 8533 ------- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO.· 2433; CHANGE LOTS 9 AND 10, BLOCK 86, ORIGINAL TOWN, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM C-4 TO C-4 (DH) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; IDENTIFYING CERTAIN EXTERIOR ARCHITECTURAL FEATURES OF THAT LANDMARK; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the M.O. Owens Building was built in 1930 at 1114 10th Street for M.O. end Lona Owens; and WHEREAS, the building was designed by Amarillo architects Kerr and Walsh; and WHEREAS, tenants included West Texas Gas Company, the West Texas Recruiting and Induction Headquarters for the U.S. Army, a variety of cotton and oil related businesses, and various governmental agencies; and WHEREAS, the Owens Building proved its durability by surviving the May 11, 1970 tornado; and WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that it would be in the best interest of the public welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, end the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Of LUBBOCK: ZONE CASE NO. 2433 SECTION 1. THAT Lots 9 and 10, Block 86, Original Town, City of Lubbock, Lubbock County, Texas, BE and is hereby changed from C-4 to C-4 (DH) Zoning District, and declared to be a historic landmark district. SECTION 2. THAT the principal building located thereon BE and is hereby declared a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with the historic landmark structure therein, in terms of style, color, materials, texture, and basic form. SECTION 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: 1) Exterior masonry walls, 2) Configuration and placement of window and door openings, 3) Ornamental stonework, 4) Main entrance surrounds, including stonework, ornamental brick- work, and wrought iron light fixtures. SECTION 5. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shell be used to indicate the degree of alteration which has already occurred and the degree of preservation of the original structure. These photographs shall be further indentified as follows: 1) General view, south facade 2) General view, north facade 3) General view, west facade 4) Close view, south entrance 5) Detail, stonework, south entrance 6) Detail, light fixture, south entrance 7) Detail, parapet, southwest corner 8) Detail, parapet, south facade. SECTION 6. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 7. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION B. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
