HomeMy WebLinkAboutOrdinance - 6989-1974 - Amending Ordinance 6490 Zone Case 1845-B - 10/23/1974KJ:dw ORDINANCE NO. 6989 AN ORDINANCE AMENDING ORDINANCE NO. 6490 OF THE CITY OF LUBBOCK, PERTAINING TO ZONE CASE NO. 1845-B, BY ADDING THERETO NEW CONDITIONS PERMITTING C-2A USES AND PROVIDING FOR PARKING; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that after all notices have been given and hearings held as provided by law, that it is in the best interest of the citizens of the City of Lubbock to make the change in the zoning law as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 6490 of the City of Lubbock BE and is hereby amended by adding thereto two new conditions which shall read as follows: 113. Development on Tract II (now known as Tract 11B 11 ) in addition to the Specific Use Permit granted in Section 2 above, shall include 11C-2A11 uses limited to the 1st and 6th Floors of the building. 4. On Tract II (Tract "B "~~ 303 parking spaces shall be provided prior to initial occupancy and 44 additional parking spaces shall be provided prior to occupancy of the third floor of the building. SECTION 2. THAT any person, firm or corporation owni.zg or operating the subject property failing to comply witfo the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be subject to a fine not to exceed TWO HUNDRED DOLLARS and each and everyd,slyrs violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section 1 hereof shall render the President, Vice-President, General Manager, Local Manager and Local Agent liable to the penalty prescribed in this section. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remahder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
