S53l AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 6279 OF THE CITY OF LUBBOCK SO AS TO AUTHORIZE THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FOR ALL VEHICLES ON THE FOLLOWING STREET IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, TO-WIT: A PORTION OF NORTH QUAKER AVENUE FRCN THE SOUTH SIDE OF CLOVIS ROAD (U.S. 84) AND EXTENDING SOUTH TO 300 FEET SOUTH OF THE CENTER LINE OF KEMPER STREET; AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS, PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CIJ4ULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; AND PROVIDING A SAVINGS CLAUSE. WHEREAS, the governing body of the City of Lubbock, as authorized by Article 6701d, Section 169(b) Vernon's Texas Civil Statutes, finds that certain prima facie speed limits on certain streets are different from what is reasonable or safe and should be altered and the preservation of public health and safety required alteration of said prima facie speed limits as hereinafter set forth, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The first part of Section 1 of Ordinance No. 6279 of the City of Lubbock which now reads as follows: SECTION 1. THAT the prima facie speed limit established by Article 6701d, Section 166(a)(1)--Vernon's Texas Civil Statutes is altered and changed for all vehicles on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, as shown below, to-wit: QUAKER AVENUE N. CITY LIMITS TO 82ND STREET A 50 MPH Speed Zone for both sides of North Quaker Avenue beginning at the North City Limits and extending South to 300 feet South of the center line of Kemper Street. BE AND THE SAME IS HEREBY AMENDED TO READ HEREAFTER AS FOLLOWS: v • SECTION 1. THAT the prims facie speed limit established by Article 6701d, Section 166(a)(1)--Vernon's Texas Civil Statutes is altered and changed for all vehicles on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, as shown below, to-wit: QUAKER AVENUE N. CITY LIMITS TO 82ND STREET A 45 MPH Speed limit for both sides of North Quaker Avenue beginning at the South side of Clovis Road (U.S. 84) and extend- ing South to 300 feet South of the center line of Kemper Street. SECTION 2. THE remainder of said Section 1 of Ordinance No. 6279 of the City of Lubbock shall remain as it presently reads. SECTION 3. THAT the City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prims facie areas set out in this Ordinance. SECTION 4. THAT any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sun not to exceed TWO HUNDRED ($200.00) DOLLARS. SECTION 5. THAT the City Secretary is authorized and directed to cause publication of the descriptive caption of this Ordinance together with the penalty as an alternative method of publication as provided by law. SECTION 6. THAT all Ordinances or parts of Ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 7. THAT all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prims facie speed limit Ordinances except those with which it specifically conflicts. SECTION 8. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. -2- • t ATTEST: APPROVED AS TO CONTENT: APPROVED AS TO FORM: AND IT IS SO ORDERED.
