Avand./Closing Portions Of Two Streets And Two Alleys In BLKS 8, 9, 10 - 01/26/1984HW:da 173:tO File And Return To Tom Nivens R-0-W ORDINANCE NO. 8530 AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF TWO STREETS AND TWO ALLEYS IN BLOCKS B, 9 AND 10, McLARTY CIRCLE VIEW ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAP OF THE CITY TO REFLECT SAID ABANDONING AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street end alley portions hereinafter described ere no longer needed for street and alley purposes end for public use; and, WHEREAS, the City Council finds it would be in the public interest to close, vacate end abandon the same for street and alley purposes and to public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street and alley portions as hereinafter des- cribed shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use; TRACT ONE A portion of a 50-foot wide street located between Block 8 and Block 9, Mclarty Circle View Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which is the most Western corner of Lot 9, Block 9, Mclarty Circle View Addition; THENCE North 48°26'01" West a distance of 50.00 feet to a point, said point being the most Southern corner of Lot 16, Block B, Mclarty Circle View Addition; THENCE North 41 °32 '08" East along the Southeast line of Lot 16, Block 8, across a 20-foot wide alley, and along the Southeast line of Lot 1, Block 8, Mclarty Circle View Addition, a distance of 298.94 feet to a point, said point being in the proposed Western right-of-way line of IH 27; THENCE South 2°34' 13" East along the proposed Western right-of-way line of IH 27 a distance of 71.84 feet to a point, said point being in the Northwestern line of Lot B, Block 9, Mclarty Circle View Addition; THENCE South 41a32'08" West along the Northwest line of Lot B, Block 9, across a 20-foot wide alley, and along the Northwest line of Lot 9, Block 9, Mclarty Circle View Addition, a distance of 247.37 feet to the POINT OF BEGINNING. TRACT TWO A portion of a 70-foot wide street located between Block 8 and Block 10, Mclarty Circle View Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which is the most Western corner of Lot 2, Block 10, Mclarty Circle View Addition; THENCE South 48°27 '1211 East along the Southwestern line of Lot 2, Block 10, Mclarty Circle View Addition, a distance of 29.04 feet to a point, said point being in the proposed Western right-of-way line of IH 27; THENCE South 2 °34' 1311 East along the proposed Western right-of-way line of IH 27 a distance of 97.50 feet to a point, said point being in the Northeastern line of Block 8, Mclarty Circle View Addition; THENCE North 48 °27 '12" West along the Northeastern line of Block 8, Mclarty Circle View Addition, a distance of 154.08 feet to a point, said point being the most Northern corner of Block 8, Mclarty Circle View Addition; THENCE North 80°47'07" East a distance of 90.38 feet to the POINT OF BEGINNING. TRACT THREE All of the 20-foot wide alley that extends from Northwest to Southeast in Block 8, Mclarty Circle View Addition to the City of Lubbock, Lubbock County, Texas. TRACT fOUR A portion of the 20-foot wide alley that extends from Northwest to Southeast in Block 9, Mclarty Circle View Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a point which is the most Northern corner of Lot 9, Block 9, Mclarty Circle View Addition; - 2 - I! THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to indicate said aban- doning end closing, showing the number of this Ordinance end the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shell not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized end directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
