AN ORDINANCE CALLING A SPECIAL ELECTION FOR SUBMISSION TO THE VOTERS or THE CITY or LUBBOCK, TEXAS, THE QUESTION or DEVELOPING THE OIL AND GAS
MINERAL ESTATE UNDERLYING THE PUBLIC PARKLANDS BELONGING TO THE CITY or
LUBBOCK AND OTHER PROVISIONS RELATED TO THE PURPOSE or THIS ORDINANCE.
WHEREAS, the City of Lubbock holds title to the public parklands as
trustee for the people of the City of Lubbock; and
WHEREAS, the City Council hes a fiduciary duty to the citizens of the
City of Lubbock to devote said perklends to the public use to which they
have been dedicated; end
WHEREAS, the City Council hes determined that development of the
mineral estate underlying such parklands would be in the best interest of
the citizens of the City of Lubbock; and
WHEREAS, the City Council of the City of Lubbock desires to ascertain
whether said governing body may be authorized to develop the mineral
estates underlying such parklends by a special election upon such issue;
NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL or THE CITY or LUBBOCK:
SECTION 1. THAT there is hereby called a Special Election of the City
of Lubbock to be conducted on April 7, 1984, in conjunction with the
Regular Municipal Election of the City of Lubbock.
SECTION 2. THAT said Special Election, which shell be held upon a
date not less than fifteen (15) nor more then ninety (90) days from the
date of final passage hereof, shall present the question of developing the
oil end gas mineral estates underlying City of Lubbock perklands es the
following proposition:
PROPOSITION
"SHALL the City Council of the City of Lubbock, Texas, grant
such oil end gas leases or enter such contracts as it deems
advisable for the development of the oil end gas mineral
estates underlying the public parklands of the City of Lubbock,
so long as the City Council allows no oil or gas well to be
drilled within the thickly settled portion of the City nor
within two hundred feet of any private residence?"

SECTION 3. THAT an electronic voting system shell be used at each
polling place on the date of the election end for absentee voting by
personal appearance.

SECTION 4. THAT the polling places shell be es is set out in Exhibit
A attached hereto end made a pert hereof for ell purposes.
SECTION 5. THAT the election officers shell be es is set out in
Exhibit A attached hereto end made a pert hereof for ell purposes.
SECTION 6. THAT on election day, the polls shell be open from 7:00
A.M. to 7:00 P.M.
SECTION 7. THAT each Presiding Judge shell appoint not less then two
nor more then six qualified clerks to serve end assist in holding said
election; provided that if the Presiding Judge actually serves, the
Alternate Presiding Judge shell be one of the clerks. Absentee voting shall
be conducted et the City Secretary's Office in the City Hall.
SECTION B. THAT all resident qualified electors of the City shell be
permitted to vote at said election. This election shell be held end
conducted in accordance with the Texas Election Code, except as modified by
Chapter 1 of Title 22, V.A.T.C.S., and, as required by law, ell election
materials end procedings shall be printed in both English and Spanish.
SECTION 9. THAT a substantial copy of this Ordinance, along with its
exhibits, shell serve es proper notice of said election. Said notice,
including a Spanish translation thereof, shell be posted at three (3)
public places within the City and at City Hall not less then fourteen (14)
days prior to the date on which said election is to be held, end published
on the same day in each of two successive weeks in a newspaper of general
circulation in said City, the first of said publications to be made not
more than fourteen (14) full days prior to the date set for the election.
AND IT IS SO ORDERED.

TAKE NOTICE that an election will be held in the City of
Lubbock, Texas, on the 7th day of April, 1984, in accordance with
an ordinance duly enacted by the City Council of the City of
Lubbock, which is attached hereto end made a part of this Notice
for all purposes.

BE IT RESOLVED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Oil and Gas
Lease between the City of Lubbock and W. E. Medlock, Sr., attached here-
with, which shall be spread upon the minutes of the Council and as spread
upon the minutes of this Council shall constitute and be a part of this
Resolution as if fully copied herein in detail.
