AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO.
2269-0; TO CHANGE A TRACT OF LAND OUT OF SECTION 14, BLOCK E-2, CITY OF
LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM C-2, AM AND A-2 TO C-3 ZONING DIS-
TRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN
SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed changes In zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for Its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, It would be expedient
and In the Interest of the public health, morals, and general welfare to
make those proposed changes In zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fut ly compiled with, as wel I
as giving notices In compllance with Section 26 of Ordinance No. 7084, as
wel I as notices provided by Article 1011f, Vernon's Annotated Civil
Statutes, amended In 1961, and notice was duly published In the Lubbock
Morning Avalanche-Journal more than fifteen (15) days prior to the date of
the publlc hearing before the City Councl I on such proposed amendment, and
the publlc hearing according to said notice was duly held In the City
Council Room on the second floor of the City Hall, Lubbock, Texas, at which
time persons appeared In support of the proposal; and, after said hearing,
It was by the City Councll determined that It would be In the public
Interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended In the manner hereinafter set forth In the body of
this Ordinance and this Ordinance having been Introduced prior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2269-0
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as fol lows, to-wit:
Change a tract of land out of Section 14, Block E-2, City of Lubbock,
Lubbock County, Texas, from C-2, AM and A-2 to C-3 Zoning District
located at 82nd Street and Quaker Avenue, subject to conditions and
being further described as fol lows:
METES AND BOUNDS DESCRIPTION of a tract located In Section 14, Block
E-2, Lubbock County, Texas, being further described as fol lows:
BEGINNING at a point which bears s. 00°03'1311 W. a distance of 84.88
feet from the Northwest corner of Section 14, Block E-2, Lubbock
County, Texas;
THENCE S. 89°56'47" E. a distance of 87.00 feet;
THENCE Northeasterly around a curve to the right, said curve having a
radius of 30.0 feet, a central angle of 89°5712711 , tangent lengths of
29.97 feet and a chord distance of 42.40 feet;
THENCE N. 89°5914011 E. a distance of 736.02 feet to a point of
curvature;
THENCE Southeasterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00
feet and a chord distance of 21.21 feet;
THENCE S. 00°00'20" E. a distance of 181.05 feet to a point of
curvature;
THENCE Southeasterly around a curve to the left, said curve having a
radius of 1068.82 feet, a central angle of 24°58'30", tangent lengths
of 236.71 feet and a chord distance of 462.22 feet to a point of
reverse curvature;
THENCE Southwesterly around a curve to the right, said curve having a
radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00
feet and a chord distance of 21.21 feet;
THENCE s. 24°58 1 50 11 E. a distance of 60.00 feet;
THENCE N. 65°01'10t1 E. an approximate distance of 45.0 feet;
THENCE S. 24° E. an approximate distance of 150.0 feet;
THENCE South an approximate distance of 485.00 feet;
THENCE West an approximate distance of 1075.00 feet;
THENCE N. 00°03'13" E. an approximate distance of 1225.11 feet to the
Point of Begtnnlng.
CONTAINS: approximately 29.2 acres
SUBJECT TO THE FOLLOWING CONDITION:
a. That the zontng be C-3 Specific Use limited to a shopping center.
SECTION 2. THAT vlolatton of any provisions of this Ordtnance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars as provided In Section 1-4 of the Ctty Code.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or Invalid for any
reason, the remalnder of this Ordinance shal I not be affected thereby.
SECTION 4. THAT the City Secretary Is hereby authorlz~d to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
