Toxic Or Poisonous Subst. - 12/08/1983JWF:cl bu e,lct~3 D te I 0, Jq<r;3 ORDINANCE NO. 8517 AN ORDINANCE AMENDING SECTION 28-107 (7) OF THE LUBBOCK CITY CODE SO AS TO FURTHER DEFINE TOXIC OR POISONOUS SUBSTANCE AS HEREINAFTER SET FORTH; AMENDING SECTION 28-107 (12) or THE LUBBOCK CITY CODE so AS TO REVISE CERTAIN SUBSTANCE REQUIREMENTS IN WATER OR WASTE WATER AS HEREINAFTER SET FORTH; AMENDING CHAPTER 28 or THE LUBBOCK CITY CODE BY ADDING A NEW SECTION 28-115 THERETO SO AS TO REQUIRE COMPLIANCE WITH FEDERAL REGULATIONS, AS TO PRETREATMENT STANDARDS AND DISCHARGE LIMITS AS HEREINAFTER SET FORTH; CONTAINING A SAVINGS CLAUSE, A PENALTY CLAUSE AND PROVIDING FOR PUBLI- CATION. WHEREAS, the City Council of the City of Lubbock finds it in the interest of public health end safety to emend the Code of Ordinances of the City of Lubbock as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL or THE CITY or LUBBOCK: SECTION 1. THAT Section 28-107 (7) of the Code of Ordinances of the City of Lubbock is hereby amended to read hereafter as follows: Any waters or wastes containing a toxic or poisonous substance (including but not limited to herbicides, pesticides, fungicides, and other organic and inorganic pollutants) in sufficient quantity to injure or interfere with any sewage treatment process, constitute a hazard to humans or animals or create any hazard in the receiving waters of the sewage treatment plant. SECTION 2. THAT Section 28-107 (12) of the Code of Ordinances of the City of Lubbock is hereby amended to read hereafter es follows: Any water or waste water containing the following substances in quantities in excess of the limits herein described: Substance Arsenic. . . . . . . . . . . . . . . . . . THAT Chapter 28 of the Code of Ordinances of the City of Lubbock is hereby amended by adding a new Section thereto to be desig- nated Section 28-115 which shall read as follows: Any industry falling within any industrial category subject to categorical pretreatment standards promulgated pursuant to Section 307(b) and (c) of the Clean Water Act of 1977 and any subsequent amendments applying to this Act shall comply with all federal regu- lations, pretreatment requirements, and/or discharge limits applicable to that particular industrial category. These federal pretreatment regulations take precedent over this Ordinance; provided, however, such industry shall continue to meet specific discharge limits set forth in this Ordinance which are not inconsistent with the categor- ical pretreatment standards applicable to its industry, and shall meet more stringent local standards which have been justified as necessary for the protection of the waste water treatment process. SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT any person, firm or corporation violating any of the provisions of this Ordinance shall, upon conviction, be fined any sum not to exceed TWO HUNDRED DOLLARS ($200.00). SECTION 6. THAT the City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. -2- ,._ ,, ... - ~ ,. , . .. ...
