Zoning Ord. #7084 And Lubbock Map For Changes: Zone Case #2427. - 10/27/1983JMS:da ORDINANCE NO. ___ 8.:;;..51;;..,;J __ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP or THE CITY or LUBBOCK so AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2427; CHANGE A TRACT or LAND OUT or SECTION 10, BLOCK JS TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM R-1 TO C-4 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2427 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 10, Block JS to the City of Lubbock, Lubbock County, Texas from R-1 to C-4 Zoning District located North of 19th Street and about 1100' west of Milwaukee Avenue, subject to conditions and being further described as follows: METES AND BOUNDS DESCRIPTION of a 2.0 acre tract located in Section 10, Block J-S, Lubbock County, Texas, being further described as follows: I. BEGINNING at a point which bears N. 89°56'57" W. a distance of 1320.00 feet end North a distance of 300.00 feet from the Southeast corner of Section 10, Block J-S, Lubbock County, Texas; THENCE North a distance of 65.40 feet; THENCE S. 89°56 '57" E. a distance of 371.48 feet; THENCE S. 00°03'03" w. a distance of 280.40 feet; THENCE N. 89°56'57" w. a distance of 292.23 feet; THENCE N. 00°03'03" E. a distance of 215.00 feet; THENCE N. 89°56'57" w. a distance of 79 .17 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITION: a. That it be approved with the deletion of the following C-4 uses. 1. Automobile body shops 2. Billboards 3. Commercial private clubs end teenage clubs 4. Dance Hell 5. Feed store 6. Game room, pool, billiard end/or domino parlor 7. Motorcycle shop 8. Night club, bar or lounge 9. Public kennel 10. Second-hand store or pawn shop 11. Used car lot 12. Used furniture store SECTION 2. THAT violation of any provisions of this Ordinance shell be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
