AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP
OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO.
1542-J; CHANGE A TRACT OF LAND OUT OF SECTION 10, BLOCK E-2, CITY Of
LUBBOCK, LUBBOCK COUNTY, TEXAS FROM C-2 TO A-2 ZONING DISTRICT; SUBJECT TO
CONDITIONS; PROVIDING fOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 Of THE
CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the
City Council finds that due to changed conditions, it would be expedient
and in the interest of the public health, morals, and general welfare to
make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 26 of Ordinance No. 7084, as
well as notices provided by Article 1011f, Vernon's Annotated Civil
Statutes, amended in 1961, and notice was duly published in the Lubbock
Morning Avalanche-Journal more than fifteen (15) days prior to the date of
the public hearing before the City Council on such proposed amendment, and
the public hearing according to said notice was duly held in the City
Council Room on the second floor of the City Hall, Lubbock, Texas, at which
time persons appeared in support of the proposal; and, after said hearing,
it was by the City Council determined that it would be in the public
interest, due to changed conditions, that the Zoning Ordinaior to first
reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 1542-J
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
Change a tract of land out of Section 10, Block E-2, City of Lubbock,
Lubbock County, Texas from C-2 to A-2 Zoning District located at 74th
Street and Toledo Avenue, subject to conditions and being further
described as follows:
BEING 5 acres of land also being the West 322.45 feet of Lot 2, Block
8 of the furr-Wolf Addition to the City of Lubbock, Lubbock County,
Texas and being more particularly described as follows:
BEGINNING at the Northwest corner of said Lot 2 same corner being on
the South right-of-way line of 71st Street;
THENCE N. 89°57'30" E 322.45' along the said South right-of-way line
of 71st Street to a point for corner;
THENCE s. 0°02'30" E 675.45 feet to a point for corner, said point
being on the North right-of-way line of 74th Street;

THENCE S. 89°57'30" W 322.45' along the said North right-of-way line
of 74th Street to a point for corner;
THENCE N. 0°02'30" W 675.45 feet along the West boundary line of said
Lot 2, also being the East bounding line of Lot 1, Block 8, Furr-Wolf
Addition to the place of beginning and containing 5 acres.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That it be tied to the site plan.
b. That either 4' standard or 6'curb back sidewalks be put on 71st
Street and 74th Street.
c. That it be limited to a retirement home.
d. That if complaints occur regarding congested traffic/parking,
additional parking will be required pursuant to the zoning
ordinance; that this condition will remain in effect for two
years from the effective date of this Ordinance.
SECfION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred
dollars as provided in Section 1-4 of the City Code.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.
