AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 ANO THE OFFICIAL MAP Ill Of THE CITY Of LUBBOCK so AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 1 2420; CHANGE A TRACT Of LAND OUT Of SECTION 26, BLOCK E-2, CITY Of LUBBOCK, !, LUBBOCK COUNTY, TEXAS FROM T TO R-1 AND R-2 ZONING DISTRICTS; PROVIDING FOR lj A PENALTY AS PROVIDED FOR IN SECTION 1-4 Of THE CITY CODE; PROVIDING A 1 SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. I WHEREAS, the proposed changes in zoning es hereinafter made have been duly presented to the Planning end Zoning Commission for its recommendation which was received by the City Council end, after due consideration, the City Council finds that due to changed conditions, it would be expedient end in the interest of the public health, morels, end general welfare to make those proposed changes in zoning; end WHEREAS, ell conditions precedent required by law fore valid amend- ment to the Zoning Ordinance end Map have been fully complied with, es well es giving notices in compliance with Section 26 of Ordinance No. 7084, es well es notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, end notice was duly published in the Lubbock Morning Avalanche-Journal more then fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, end the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hell, Lubbock, Texas, et which time persons appeared in support of the proposal; and, after said hearing, it wee by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance end the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance end this Ordinance having been introduced prior to first reeding hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: ZONE CASE NO. 2420 SECTION 1. THAT Ordinance No. 7084 end the Official Zoning Map BE end the same ere hereby amended es follows, to-wit: Change e tract of lend out of Section 26, Block E-2, City of Lubbock, Lubbock County, Texas from T to R-1 end R-2 Zoning Districts located et 98th Street end Frankford Avenue, end being further described es follows: T TO R-1 METES AND BOUNDS DESCRIPTION of a tract of land located in Section 26, Block E-2, Lubbock County, Texas, being further described es follows: BEGINNING et e point which beers North en approximate distance of 755.0 feet from the Southwest corner of Section 26, Block E-2, Lubbock County, Texas; THENCE North an approximate distance of 570.0 feet; THENCE East an approximate distance of 2641.7 feet; THENCE South an approximate distance of 1323.43 feet; THENCE West an approximate distance of 1566.0 feet; THENCE North an approximate distance of 610.0 feet; THENCE East an approximate distance of 28.0 feet; THENCE North an approximate distance of 145.0 feet; THENCE West an approximate distance of 1090.0 feet to the Point of Beginning. CONTAINS: approximately 61.75 acres T TO R-2 METES AND BOUNDS DESCRIPTION of a tract of land located in Section 26, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a a point which bears North an approximate distance of 465.0 feet from the Southwest corner of Section 26, Block E-2, Lubbock County, Texas; THENCE North an approximate distance of 290.0 feet; THENCE East an approximate distance of 1090.0 feet; THENCE South an approximate distance of 145.0 feet; THENCE West an approximate distance of 28.0 feet; THENCE South an approximate distance of 610.0 feet; THENCE West an approximate distance of 295.0 feet; THENCE North an approximate distance of 465.0 feet; THENCE West an approximate distance of 780.0 feet to the Point of Beginning. CONTAINS: approximately 10.31 acres SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. . . ' SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
