AN ORDINANCE AMENDING ZONING ORDINANCE NO. 5962 OF THE CITY
OF LUBBOCK COVERING ZONE CASE NO. 1615D PERTAINING TO A TRACT OF
LAND OUT OF SECTION 28, BLOCK E-2, LUBBOCK COUNTY, TEXAS, BY
CHANGING A CONDITION MADE A PART THEREOF REGARDING A SITE PLAN; r--',-1 ADDING NEW CONDITIONS THERETO; REPEALING ORDINANCE NO. 6077 OF
THE CITY OF LUBBOCK WHICH AMENDED ORDINANCE NO. 5962; PROVIDING
A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLI-
CATION.

I WHEREAS, the City Council finds that after all notices have been given and
hearings held as provided by law, and that it is in the best interest of the
citizens of the City of Lubbock to make the change in the zoning law as set forth

SECTION 1. THAT Zonlng Ordinance No. 5962 of the City of Lubbock BE
and is hereby amended by amending condition two (2) thereof which shall read as
follows:
(2) Development shall be in accordance with the revised site
plan approved by the City Council on vAc;;tgbe:rc·1.o·,. , ,, ,
1974. This approved site plan covers not only the property
described in this ordinance but the entire Tracts A and B.,
South Plains Mall Addition, City of Lubbock, Texas. The
setbacks, landscaping and limitation on no additional
free-standing signs shall be as shown on the approved
site plan.
Property covered by this Ordinance and Ordinance No. 5962 is
described as follows:
A tract of land out of Section 28, Block E-2, Lubbock County,
Texas and being more particularly described as follows:
BEGINNING at a point 2640. 0 feet North and 1560. 0 feet West
of the Southeast corner of Section 28., Block E-2, for the
Northeast and beginning corner of this tract;
THENCE South O 0 oor 2711 East, 150. O feet to a corner of this
tract;
THENCE South 89° 59r 3311 West, 520. O feet to a corner of this
tract;

THENCE Southwesterly around the arc of a curve to the right
whose radius is 211. 48 feet, 126.13 feet to a point in the North
R.O. W. line of Loop 289;
THENCE North 55 ° 50' 1011 West, 731. 63 feet to the P. C. of
a curve to the right;
THENCE Northwesterly around the arc of a curve to the right
893. 35 feet to the Northwest corner of this tract;
THENCE North 89° 591 3311 East, 1807. 23 feet to the PLACE
OF BEGINNING.
Containing 19. 003 Acres.
SECTION 2. THAT Ordinance No. 6077 of the City of Lubbock, which
amended the same condition two (2) of Ordinance No. 5962i BE and is hereby
repealed.
SECTION 3. THAT any person, firm or corporation owning or operating
the subject property failing to comply with the conditions imposed by Sect ion l
hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be
subject to a fine not to exceed TWO HUNDRED DOLLARS and each and everyday's
violation thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property to
comply with any of the conditions imposed by Section 1 hereof shall render the
President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this section.
SECTION 4. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative method
provided by law.
AND IT IS SO ORDERED.
