HomeMy WebLinkAboutOrdinance - 6964-1974 - Amending Section 18-37(A) Vehicle Driver Accident Report - 08/22/1974ORDINANCE NO. _::..69::.::6:...:.4 __ _ AN ORDINANCE AMENDING SECTION 18-37(.A) OF THE CODE OF ORDINANCE OF THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, SO AS TO CHANGE REQUIREMENTS WITH RESPECT TO VEHICLE DRIVER ACCIDENT REPORTS TO THE LUBBOCK POLICE DEPARTMENT AS SET FORTH IN THE BODY OF THIS ORDINANCE; PROVIDING A SAVINGS CLAUSE; PRESCRIBING A PENALTY FOR VIOLATION OF THIS ORDINANCE; AND PROVIDING FOR PUBLICATION. WHEREAS,. the City Council of the City of Lubbock finds it would be to the pub- lic interest,. health., safety,. and general welfare to amend the Code of Ordinapces . of the City of Lubbock so as to more clearly define the duties of a driver of a moto ehicle as regards reporting an accident to the Lubbock Police Department; NOW THEREFORE E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: SECTION 1.: THAT Section 18-37 (A) of the Code of Ordinances of the City of Lubbock .. Texas which now reads as follows: 11Sec. 18-37 (a) The driver of a vehicle involved in an accident within the corporate limits of the City of Lubbock .. Texas resulting in injury to or death of an person or damage to any property. real or personal,. shall immediately and by the quickest means of communication give notice oe such accident to the police department of the City of Lubbock .. Texas. (Ord. No. 4116. 6-27-63)11 E AND THE SAME IS hereby amended to read hereafter as follows: 11Sec~: 18-37(.A) The driver of a vehicle involved in an accident resulting in death, inJury or apparent property damage of TWENTY-FIVE ($25. 00} DOLLARS or more within the corporate limits of the City of Lubbock., Texas., shall immediately and by the quickest means of communication, give notice of such accident to the police department of the City of Lubbock,. Texas. This includes all accidents occurring on public streets, or highways. or other public property., or on any private property commonly used by the public such as supermarkets., or shopping center parking lots., parking areas provided by business establishments for the convenience of their customers. clients., or patron~, parking lots owned and operated by the state or any other parking area owned and operated for the convenience o and commonly used by. the public; PROVIDED, HOWEVER, that this section shall not apply to accidents occurring on privately owned resident ial parking areas or on privately owned parking lots where a fee is charg d for the privilege of parking or storing a motor vehicle. 11 ======41========-============ ...... ---=======-=======#'== SECTION 2. THAT should any Section, paragraph, sentence., clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT any person., firm or corporation violating the terms of Section 18-37(A) of the Lubbock City Code as established by this Ordinance shall., upon conviction, be fined any sum not to exceed TWO HUNDRED ($200. 00) DOLLA SECTION 4. THAT the City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law.
