Zoning Ord. #7084 And Lubbock Map Changes: Zone Case #2419 - 09/22/1983SMH:da tt-~J--1; 3 10-13-t~ ORDINANCE NO. 8496 ----- AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OffICIAL MAP Of THE CITY Of LUBBOCK SO AS TO MAKE THE fOLLOWING CHANGES: ZONE CASE NO. 2419; CHANGE A TRACT Of LAND OUT Of SECTION 4, BLOCK E, CITY Of LUBBOCK, LUBBOCK COUNTY, TEXAS fROM R-1 TO R-2 ZONING DISTRICT; PROVIDING fOR A PENALTY AS PROVIDED fOR IN SECTION 1-5 Of THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING fOR PUBLICATION. WHEREAS, the proposed changes in zoning es hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council end, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morels, end general welfare to make those proposed changes in zoning; end WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance end Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, es well es notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, end notice was duly published in the Lubbock Morning Avalanche-Journal more then fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, end the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hell, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be emended in the manner hereinafter set forth in the body of this Ordinance end this Ordinance having been introduced prior to first reeding hereof; NOW THEREfORE: BE IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: ZONE CASE NO. 2419 SECTION 1. THAT Ordinance No. 7084 end the Official Zoning Map BE end the same ere hereby emended es follows, to-wit: Change a tract of lend out of Section 4, Block E, City of Lubbock, Lubbock County, Texas from R-1 to R-2 Zoning District located et Loop 289 end Avenue U end being further described es follows: METES AND BOUNDS DESCRIPTION for a 0.73 acre tract located in Section 4, Block E, Lubbock County, Texas, being shown es Lots 408 thru 412 on the preliminary plat of Beverly Heights Addition to the City of Lubbock, Lubbock County, Texas, being further described es follows: BEGINNING et the Northeast corner of Lot 386, Beverly Heights Addition to the City of Lubbock, Lubbock County, Texas; THENCE N. 89a57'03" E. a distance of 285.00 feet toe point of curvature; • THENCE Southeasterly around e curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00 feet, end e chord distance of 21.21 feet; THENCE S. 00°02 157" W. a distance of 91.55 feet; THENCE S. 89°57 '03" W. a distance of 300.00 feet; THENCE N. 00°02 157" E. e distance of 106.55 feet to the Point of Beginning. SECTION 2. THAT violation of any provisions of this Ordinance shell be deemed e misdemeanor punishable bye fine not to exceed two hundred dollars es provided in Section 1-5 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shell not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
