HomeMy WebLinkAboutOrdinance - 6954-1974 - Amending Zoning Ordinance 1695 Zone Case 1974 Westhaven Addition. - 08/21/1974ORDINANCE NO. 6954 __ .;;;.;:..~---- AN ORDINANCE AMEN,DING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW- ING CHANGE: ZONE CASE NO. 1974: CHANGE LOTS 25 THROUGH 32, BLOC 10, LOTS 16 AND 17., BLOCK 11., THE SOUTH 115 FEET OF THE EAST 220 FEET OF TRACT 1# WESTHAVEN ADDITION, AND THAT AREA BEGINNING AT THE NORTHEAST CORNER OF LOT 32, BLOCK 10., WESTHA VEN ADDITION THENCE EAST A DISTANCE OF 50 FEET; THENCE SOUTH A DISTANCE OF 95 FEET; THENCE WEST A DISTANCE OF 50 FEET; THENCE NORTH A DISTANC OF 95 FEET TO THE PLACE OF BEGINNING; TIDS AREA ALSO LYING WITH- IN THE WESTHAVEN ADDITION, CITY OF LUBBOCK., LUBBOCK COUNTY, TEXAS FROM AN "R-1" 11C-1 rr "C-211 AND 11C-311 TO A 11C-2A'1 ZONING , , , DISTRICT; CHANGE LOTS 10 TEffiOUGH 17, WESTHAVEN ADDITION FROM A '1C-311 TO A "C-311 20NING DISTRICT., SUBJECT TO CONDITIONS; PROVID- ING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUB- LICATION. WHEREAS., the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zonirg Commission for its recom- mendation, which was received by the City Council and after due consideration., the City .Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS., all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with .. as well as giving notices in compliance with Section 20 of Ordinance No. 1695., as well as notices provided by Article lOllf, Vernon's Annotated Civil Statutes .. amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the Second Floor of the City Hall., Lubbock., Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zo- ning Map be amended in the manner hereinafter set forth in the body of this Ordi- nance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 1974 Change Lots 25 through 32, Block 10, Lots 16 and 17, Block 11, the South 115 feet of the East 220 feet of Tract 1, Westhaven Addition, and that area beginning at the Northeast corner of Lot 32, Block 10., Westhaven Addition, thence East a distance of 50 feet; thence South a distance of 94 feet; thence West a distance of 50 feet; thence North a distance of 95 feet to the Place of Beginning; this area also lying within the Westhaven Addition., City of Lubbock., Lubbock County, Texas., from an '1R-111.,. "c-111.,. 11c-211 and "C-311 to a 11C-2A11 Zoning District. Change Lots 17 through 20.,. Westhaven Additin.,. City of Lubbock, Texas from 11C-3" to a "C-311 Zoning District Subject to the following conditions: Development shall be limited to a service station. 11C-2A" signs plus one pylon sign not to exceed 21' in height shall be permitted. SECTION 2. THAT from and after passage and effective date of this Grclinance., said lots., tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. SECTION 3. THAT any person., firm or corporation owning or operatin the subject property failing to comply with the conditions imposed by Section 1 hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be sub- ject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day1s violation thereof shall constitute a separate and distinct offense. The failure of any corporation owning or operating the subject property to comply with any of the conditions imposed by Section 1 hereof shall render the President., Vice-President., General Manager.,. Local Manager and Local Agent liable to the penalty prescribed in this Section. SECTION 4. THAT should any Section, paragraph., sentence., clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason., the remainder of this Ordinance shall not be affected there by. SECTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
