Ch.7 By Adding New Sec 7-35 Related To Appointment Of Persons - 09/08/1983DGV:da ORDINANCE NO. 8490 AN ORDINANCE AMENDING CHAPTER 7 OF THE CODE OF O INANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING THERETO A NEW SECTION 7-35 P RTAINING TO THE APPOINT- MENT OF PERSONS TO THE CIVIL SERVICE CLASSIFICATION I DIATELY BELOW THAT OF POLICE CHIEF AND FIRE CHIEF IN THE POLICE AND FIRE DEP TMENTS OF THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the State Legislature has amended the pr visions of Vernon's An.n.Civ.St., art. 1269m, the Firemen's and Policemen's -C::t_vil Service Act, by adding thereto a new Section SA, which section allows olfce and fire chiefs to appoint those persons serving in the classification immediately below police chief or fire chief; and WHEREAS, the City of Lubbock meets the criteria fr exercise of such appointment provision by virtue of having at least fou classifications below the classification of chief in each department; and WHEREAS, the police chief and the fire chief desi e to make such appoint- ments; and WHEREAS, the City Council of the City of Lubbock eems it to be in the best interest of the health, safety and welfare of the citizens of the City of Lubbock to enable such appointments by passage of this ordinance; NOW THERE- FORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBB CK: SECTION 1. THAT a new Section 7-35 BE and is her by added to the Code of Ordinances of the City of Lubbock, Texas, which sectio shall read as follows: Sec. 7-35. Appointment of assistants to police chef and fire chief. The police chief and the fire chief shall ha e the authority to appoint persons to serve in the classification ediately below chief in accordance with applicable provisions of state la. The number of persons appointed to serve in such classification shall npt exceed the number allowed by state law. Any person appointed by a bhief who is subsequently removed from the position by a chief shall be rei stated in the applicable department and placed in the same classification, or its equivalent, that the person held prior to appointment, and retains all rights of seniority in the department. SECTION 2. THAT should any section, paragraph, s, ntence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall·not be fected thereby. SECTION 3. THAT the City Secretary is hereby aut orized and directed to cause publication of the caption of this Ordinance as n alternative means of publication provided by law. -I! ..
