Zoning Ord. #7084 And Lubbock Map Changes: Zone Case #2067-B - 08/25/1983I "I I SMH:da ORDINANCE 8485 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2067- B; CHANGE A TRACT OF LAND OUT OF SECTION 9, BLOCK JS, C TY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM A-1 TO C-4 WITH LIMITED USES ZONING !STRICT; SUBJECT TO CONDITIONS: PROVIDING FOR A PENALTY AS PROVIDED FOR IN ECTION 1-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBL CATION. WHEREAS, the proposed changes in zoning as hereina duly presented to the Planning and Zoning Commission fo which was received by the City Council and, after due c Council finds that due to changed conditions, it would interest of the public health, morals, and general welf proposed changes in zoning; and ter made have been its recommendation nsideration, the City e expedient and in the re to make those WHEREAS, all conditions precedent required by law or a valid amendment to the Zoning Ordinance and Map have been fully complie with, as well as giving notices in compliance with Section 26 of Ordinan e No. 7084, as well as notices provided by Article lOllf, Vernon's Annotated C vil Statutes, amended in 1961, and notice was duly published in the Lubbock M rning Avalanche- Journal more than fifteen (15) days prior to the date o the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Coun il Room on the second floor of the City Hall, Lubbock, Texas, at which time p rsons appeared in support of the proposal; and, after said hearing, it wa by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and thi Ordinance having been introduced prior to first reading hereof; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBO ZONE CASE NO. 2067-B SECTION 1. THAT Ordinance No. 7084 and the Off cial Zoning Map BE and the same are hereby amended as follows, to-wit: Change a tract of land out of Section 9, Block JS, City of Lubbock, Lubbock County, Texas from A-1 to C-4 with limited uses Zoning District located about 700' north of 19th Street and west o Loop 289, and subject to conditions. METES AND BOUNDS DESCRIPTION of a 10.725 acre trac of land located in Section 9, Block J-S, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears South a distance f 2013.43 feet and N. 89°59' E. a distance of 372.00 feet from the Nort est corner of the Southeast Quarter of Section 9, Block J-S, Lubbock county, Texas; THENCE North a distance of 575.00 feet; THENCE N. 89°59' E. a distance of 495.00 feet; THENCE s. 62°33'37" E. a distance of 533.56 feet; THENCE s. 43°39'20" W. a distance of 651.00 feet; THENCE N. 46°20'40" W. a distance of 205.47 feet; THENCE S. 89°59' W. a distance of 370.47 feet to the Point of Beginning. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Cdde. SECTION 3. THAT should any paragraph, sentence. clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
