Zoning Ord. #7084 And Lubbock Map Changes: Zone Case # 2416. - 08/25/1983SMH:da ORD;rNI CE NO~ 8484 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO A~ TO MAKE THE FOLLOWING CHANGES ZONE CASE NO. 2416; CHANGE A TRACT OF LAND OUT OF SECTION 26, BLOCK E-2 TO JHE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS FROM R-1 TO C-3 ZONING DISTRICT; ~'UBJECT TO CONDITIONS; PROVIDING FOR A PENALTY-AS PROVIDED FOR IN SECTION 1-4 F THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATIO. WHEREAS, the proposed changes in zoning as hereinatter made have been duly presented to the Planning and Zoning Commission fof its recommendation which was received by the City Council and, after due c nsideration, the City Council finds that due to changed conditions, it would e expedient and in. the interest of the public health, morals, and general welf re to make those proposed changes in zoning; and : WHEREAS, all conditions precedent required by law :· or a valid amendment to the Zoning Ordinance and Map have been fully complie with, as well as giving notices in compliance with Section 26 of Ordinan e No. 7084, as well as notices provided by Article lOllf, Vemon's Annotated Civil Statutes, amended I in 1961, and notice was duly published in the Lubbock M~rning Avalanche- Journal more than fifteen (15) days prior to the date 01· the public bearing before the City Council on such proposed amendment, and the public bearing according to said notice was duly held in the City Coun il Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in I support of the proposal; and, after said hearing, it wa$ by the City Council determined that it would be in the p.ublic interest, due~'to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner here- inafter set forth in the body of this Ordinance and thi Ordinance having been introduced prior to first reading hereof; NOW THEREFORE 1 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBB01K: the ZONE CASE NO. 2416 I SECTION 1. THAT Ordinance No. 7084 and the Off~cial Zoning Map BE and same are hereby amended as follows, to-wit: • Change a tract of land out of Section 26, Block E-J, City of Lubbock, Lubbock County, Texas from R-1 to C-3 Zoning District located at 82nd Street and Slide Road, subject to conditions and b~ing further described by metes and bounds as follows: ; METES AND BOUNDS DESCRIPTION for a 14.027 acre trajt located in Section 26, Block E-2, Lubbock County, Texas, being shown ~s Lot 1, Heald Addi- tion to the City of Lubbock, Lubbock County, Texas,J being further des- cribed as follows: i BEGINNING at a point which bears N. 89°53'15" W., d5.26 feet and S. 00°01 1 3011 W, 65.00 feet from the Northeast corner ~f Section 26, Block E-2, Lubbock County, Texas; THENCE Southeasterly around a curve to the right, said curve having a radius of 30.00 feet, a central angle of 89°54145", tangent lengths of 29.95 feet, and a chord distance of 42.39 feet; THENCE S. 00°01'30" W. a distance of 754.18 feet; THENCE N. 89°55 1 35" W. a distance of 774.16 feet; THENCE N. 00°00'16" W. a distance of 779.13 feet to a point of curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°07'01", tangent lengths of 15.03 feet, and a chord distance of 21.23 feet; THENCE s. 89°53'15" E. a distance of 321.59 feet; THENCE S. 87°01'17" E. a distance of 200.00 feet; THENCE s. 89°53'15" E. a distance of 208.00 feet to the Point of Begin- ning SUBJECT TO THE FOLLOWING CONDITIONS: a. That it be limited to the following uses: 17.3-1 -Any use unconditionally permitted in the "C-2A" and"C-2" Districts. 17.3-5 -Department store, "discount" center, "family" center. 17.3-6 -Gasoline service station. 17.3-7 -Grocery store. 17.3-12-Theater and motion picture show. 17.3-13-Tire, battery and accessory stores. b. That it be subject to site plan approval prior to issuance of the building perm.its. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
