Sec. 28-92 To Change The Rates For Sewer Service. - 08/25/1983I ~-d-:>-i3 q--1:,-~'?:> JWF/mck ORDINANCE NO. 8479 AN ORDINANCE AMENDING SECTION 28-92 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, IN ITS ENTIRETY SO AS TO CHANGE THE RATES FOR SEWER SERVICE WITHIN THE CITY OF LUBBOCK EFFECTIVE OCTOBER 1, 1983; PROVIDING 'A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council is of the opinion and deems it to be in the public interest that sewer service rates be increased as is herein set out in order to provide adequate sewer service for the citizens of the City of Lubbock; WHEREAS, the City Council's intention is to establish sewer service rates that will adequately cover operational, maintenance and capital costs; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 28-92 of the Code of Ordinances of the City of Lubbock, Texas, be and is amended to read as follows: "(a) Sewer service charges presently in effect under this Section shall remain in effect until October 1, 1983, and effective for all bil- lings scheduled to be rendered on and after October 1, 1983, there shall be charged for sewer service to all residences, places of business, pri- vate and public buildings, churches, schools, institutions, and all other sewer service customers the following service charge: Individually Metered Residential Units: $ 2.20 per month minimum including 3,000 gallons; $0.2lper thousand gallons per month thereafter maximum charge $3.67 {10,000 gallons per month) for each non-sprinkler meter. Individually metered residential units shall pay the above service charge based on a calculated estimate of sewer flow determined from water con- sumption records for individual customers. Water consumption information for months of typically low irrigation usage will be examined to establish a "basis" for sewer service charges. Sewer charges will be levied based on water consumption up to the maximum determined by the "basis". The basis for new customers shall be 6,000 gallons until adequate historical information is available. Commercial: 5/8 inch or 3/4 inch meter 1 inch meter $ 2.20 per month minimum including 3,000.gallons; $0.21 per thousand gallons per month thereafter $ 4.36 per month minimum including 3,000 gallons; $0.21 per thousand thereafter l½ inch meter 2 inch meter 3 inch meter 4 inch meter 6 inch meter 8 inch meter 10 inch meter $ 1.23 per month minimum including 3,000 gallons; $0.21 per thousand thereafter $ 10.10 per month minimum including 3,000 gallons; $0.21 per thousand thereafter $ 25.90 per month minimum including 3,000 gallons; $0.21 per thousand thereafter $ 44.57 per month minimum including 3,000 gallons; $0.21 per thousand thereafter $ 90.53 per month minimum including 3,000 gallons; $0.21 per thousand thereafter $130.03 per month minimum including 3,000 gallons; $0.21 per thousand thereafter $209.02 per month minimum including 3,000 gallons; $0.21 per thousand thereafter. Commercial accounts may be adjusted to·exclude in-plant losses. Universities, Schools, Geriatric Institutions, Orphan Homes, Public or Private Institutions, Public Schools, Churches and all other sewer service customers except individually metered re- sidents and industrial customers: Industrial: Multi-family Residential (Non-individually metered Residential Units): The charge for these users shall be the same as the commercial rate. The charge tor industrial users shall be the same as the commercial rate; however, industrial waste that exceeds the allowable strength shall be admitted to the sewer only by con- tract with the City. The charge for treating B.O.D. shall be $0.0491/lb. and treating S.S. shall be $0.0433/lb. The charge for these users shall be the same as the commercial rate. •• t ' ·, •.,, : :-. . •• • (b) The rates for sewer service as shown in paragraph (a) next- above, shall be reviewed annually to insure the adequacy of the rates to cover the total cost of operation, maintenance, and capital costs. These rates shall be examined by the Director of Finance and the Director of Finance shall make such recommendations for adjustments and changes in such rates to the City Council as deemed necessary after each such annual review for consideration by the City Council. (c) The charges assessed above shall be collected by the City of Lubbock and included on its regular water statements. In the event the person, firm, corporation, or institution does not receive water from the Water Utilities Department, a separate monthly statement shall be sent covering such sewer service based upon a 6,000 gallon per month sewer flow for residential customers and an on-site survey of estimated sewer flow by the Water Utilities Department of the City for all other type customers." SECTION 2. THAT should any paragraph, section, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary is hereby authorized to cause pub- lication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
