AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2296-
A; CHANGE LOTS 18, 19, 20 and 21 IN THE GATEWOOD ADDITION TO THE CITY OF
LUBBOCK, LUBBOCK COUNTY, T~S FROM R-1 TO A-2 LIMITED TO CHURCH AND CHURCH
RELATED USES ZONING DISTRICt; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY
AS PROVIDED FOR IN SECTION +-4 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATI¢N.

WHEREAS, the proposed ¢hanges in zoning as hereinafter made have been
duly presented to the Planning and Zoning Commission for its recommendation
which was received by the City Council and, after due consideration, the City
Council finds that due to changed conditions, it would be expedient and in the
interest of the public health, morals, and general welfare to make those
proposed changes in zoning; j and
WHEREAS, all conditions precedent required by law foT a valid amendment
to the Zoning Ordinance andlMap have been fully complied with, as well as
giving notices in complianc with Section 26 of Ordinance No. 7084, as well as
notices provided by ArticleilOllf, Vernon's Annotated Civil Statutes, amended
in 1961, and notice was duli published in the Lubbock Morning Avalanche-
Journal more than fifteen (~5) days prior to the date of the public hearing
before the City Council on ~uch.proposed amendment, and the public hearing
according to .said notice wa~ duly held in the City Council Room on the second
floor of the City Hall, Lubijock, Texas, at which time persons appeaTed in
support of the proposal; and, after said hearing, it was by the City Council
determined that it would be 1:f.n the public interest, due to changed conditions,
that the Zoning Ordinance arid the Zoning Map'be amended in the manner herein-
after set forth in the body \of this Ordinance and this Ordinance having been
introduced prior to first r~ading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY 90UNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2296-A
I SECTION 1. THAT Ord1inance No. 7084 and the Official Zoning Map BE and
the same are hereby amended AS follows, to-wit:
Change Lots 18, 19, 20 ~nd 21 in the Gatewood Addition to the City of
Lubbock, Lubbock County, Tex.as from R-1 to A-2 limited to church and
church related uses zon~ng district, located at 2s·o1 79th Street and
subject to the followinf conditions:
a. Tied to the site ptl.an pTesented to the City Council.
b. Limited to church rnd church related uses.
c. That the exit onto1 the alley of Lot 21 be pemitted provided that
the alley is paved:.
d. That a screening ffnce on the west side of Lot 21 be installed.
SECTION 2. THAT violation of any provisions of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed two hundred dollars
as provided in Section 1-4 of the City Code.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word
of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause
publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

Zone Case 2296-A
The Planning and Zoning Commission recommends that this request be
denied.
In accordance with Notice published in the Lubbock Avalanche Journal
on -,Iuue s , 1983 , a public hearing was held on the
above matter.
Proponent: Frank L. King
This case was denied by P&Z because Proponent failed to appear, and
under the rules of P&Z, automatic denials occur in "no show" cases.
Proponent took exception to this fact, inasmuch as hfs had car •
trouble enroute to the hearing, and a telephone was inaccessible.
The request is for A-2 limited to church and church-related uses.
Adjacent land uses is existing church on the north; existing single
family on the south and west; and existing commercial on the east.
The proposal is situated in R-1 development, and normally churches
are located on major thoroughfares because of parking and traffic
flow. Additionally, there is a lot across the street which is a
part of this cas~ and that is a complicating factor.
Opponent: Bud Myers, a resident
Mr. Myers opposes the case because his home is in that area an such
a structure would devaluate the residential property and create
traffic problems in the area.
After closing the hearing, the motion was made by Councilwoman
Baker, seconded by Councilman Brown to remand the case back to P&Z
for public hearing, at-no additional advertising expense to the
Proponent. Motion carried: 5 Yeas; 0 Nays.
Hold a public hearing for the 1983-84 Community Developm~nt
Jobs Bill appropriation.
In accordance with Notice published in the Lubbock Avalanche Journal
on June 8 , 1983 , a pub 1 ic hearing was he 1 d on the
above matter.
