Penalties For Violation Of Provisions. - 06/09/1983DGV :da ORDINANCE NO. 8453 AN ORDINANCE AMENDING SECTIONS 4-2, 4-41 AND 4-67 OF THE CODE OF ORDIN- ANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO PENALTIES FOR VIOLATION OF THE PROVISIONS OF CHAPTER 4 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION . WHEREAS, certain sections of Chapter 4 of the Code of Ordinances of the Ci t y of Lubbock provide for penalt i es o ther than those provided for violation of city ordinances i n general ; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interests of the citizens of the City of Lubbock that such penalties should be standardized; NOW THEREFORE : BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK : SECTION 1. THAT Sec. 4-2 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as f ollows : Sec. 4-2. Penalties. Any person violating any provision of this chapter shall be deemed guilty of a misdemeanor and shall be punished in accordance with the provisions of Sec. 1-4 of this Code . Continuing or repeated violations shall be deemed to be separate offenses. SECTION 2. THAT Sec. 4-41 of the Code of Ordinances of t he City of Lubbock BE and is hereby amended to read as follows: Sec . 4-41. Failure to obtain or attach license. Any person who fails to obtain a current license tag or fails to attach said tag to the animal's collar or harness shall be guilty of a misdemeanor punishable in accordance with the provisions of Sec. 1-4 of this Code. SECTION 3. THAT Sec . 4-67 of the Code of Ordinances of the City of Lubbock BE and is hereby amended to read as follows : Sec. 4-67. Citations issued. (a ) In lieu of impounding a dog found not under restraint or an pnimal deemed to be a public nuisance, the city enforcement agent may issue to the known owner of such dog or animal a notice of ordinance violation. Such notice shall require the dog 's owner to appear in muni- cipal court to answer such citation. Upon conviction of a violation of this Chapter, such owner shall be punishe d in accordance with the pro- visions of Sec . 1-4 of this Code . :: (b) In the event that such owner shall fail to appear in municipal court at the time prescribed to answer such citation to appear, such failure to appear shall in and of itself be a violation of this Chapter punishable in accordance with the provisions of Sec . 1-4 of this Code. 11 SECTION 4. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby . SECTION 5 . THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alter- native method provided by law. AND IT IS SO ORDERED . Passed by the City Council on first reading this 9th day of June , 1983. Passed by the City Council on second reading this 23rd day of June , 1983.
