HomeMy WebLinkAboutOrdinance - 6899-1974 - Amending Chapter 30 Code Of Ordinances "Tax Board Of Equalization" - 05/09/1974ORDINANCE NO. 6899 AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, TEXAS, BY ADDING THERETO A NEW ARTICLE III ENTITLED 11TAX BOARD OF EQUALIZATION"; PROVIDING FOR APPOINTMEN OF MEMBERS; PROVIDING FOR TERMS OF OFFICE; PROVIDING FOR DUTIES OF SUCH BOARD MEM BERS; PROVIDING FOR SAVINGS CLAUSE AND PROVID- ING FOR PUBLICATION. WHEREAS., the City Council, after receiving the recommendation of the Tax Study Committee, has determined that the change in the Tax Board of Equalization as set forth below would be in the best interest of the citizens of the City of Lubboc NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT-Chapter 30 of the Code of Ordinances, City of Lubbock, Texas, BE and is hereby amended by adding thereto a new Article III, entitled 11Tax Board of Equalization", which shall read as follows: AR TIC LE III. Tax Board of Equalization Section 30-13. Tax Board of Equalization. There is hereby created a Tax Board of Equalization. Section 30!'!14. Appointment, terms and qualifications of members. The Tax Board of Equalization shall be composed of 12 members. Each member shall be a qualified vat er, a resident and property owner of the City of Lubbock. All of the members of the board shall be appointed by the City Council of the City of Lubbock and the Board of Trustees of the Lubbock Independent School District. Each Board member shall serve for a term of 3 years., except however., the original members of the Board shall be appointed to serve terms of 1, 2., and 3 years as determined by the City Council and the Board of Trustee ., with the intent being to stagger the expiration of terms and new appoint- ments to insure continuity of the Board. Section 30-15. Vacancies: removal Vacancies on the Board whether by expiration, or term,. death., resignatio or removal., shall be filled by the City Council and the Board of Trustees. Any members who fail to attend three (3) consecutive meetings of the Board for any reason other than sickne.ss or absence from the City shall become disqualified to serve on the Board and upon certification by the secretary of the Board, the City Council and the Board of Trustees shall thereupon appoint a successor to complete the unexpired term. _;-..; "'1..- ____.t_d ~ ·-:i:==J=:E=W==========================================t== --....... ~ .... u Section 30-16. Duties of Board, term, quorum. The term of the board's activities and authority shall be continuous one year term from the time of annual organization in the month of January of each year; except, however, such Board may be organized for its first year activities upon the effective date of this Ordinance. Seven members of the board shall constitute a quorum for the transactio of the business of the board but no action of the board shall be of any force or effect unless it is passed by a majority of the members present at any such meeting. The Tax Board of ~qualization shall meet each year, on dates set by the Board, and shall cause the tax assessor to bring before them the assessment books or lists of the City and school l:district for their examination for the purpose of equalizing such assessments. Said board shall have the powers set forth by the Constitution and Statutes of the State of Texas and the Charte and Ordinances of the Citjf of Lubboc~ and the adopted written policies of the Board of Trustees. The board may appoint sub-committees to investigate and hear any parti cular items coming before the board; however, decisions as to final evalua- tion shall only be reached by the board. The board may recess its meetings and hearings upon its own determina tion, but may be reconvened by the Chairman or any two members or the tax assessor upon notice to the members of the board that a meeting is needed. SECTION 2. THAT should any section, paragraph., sentence, clause, phrase r word of this Ordinance be declared unconstitutional or invalid for any reason the emainder of this Ordinance shall not be affected thereby.
